Bragdon, l.x lra Director of Community Development ^^st^ DATE: May 19, 1987 j @ CAXM SUBJECT: Hearing on Rezoning Application 2700-RZ to rezone 6.5 acres of land located at the westerly extension of Wood Glen Drive, northeast of the intersection of Laurel Road and Byron Road in the Oakley area from General Agriculture (A-2) to Planned Unit District (P-1) and Development Plan 3058-86 to construct 25 residences and Tentative Map 6872 for a subdivision filed by Bellecci and Associates (Applicants) and Signature Properties (Owners) . SPECIFIC REQUEST(S) OR RECOMmENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Approve Rezoning Application 2700-RZ as recommended by the East County Regional Planning Commission. 2. Approve Development Plan 3058-86 with conditions as recommended by the East County Regional Planning Commission (attached as Exhibit A) . 3. Approve Tentative Subdivision map 6872 with conditions as recommended by the East County Regional Planning Commission (attached as Exhibit B) . 4. Adopt the East County Regional Planning Commission findings as set forth in Resolution No. 10-1987 as the determinations for these actions. 5. Introduce the ordinance giving effect to the aforesaid rezoning, waive reading and set date for the adoption of same. A CONDITIONS OF APPROVAL FOR DEVELOPMENT PLAN 3058-86 1. These final development plans are approved as indicated on plans dated December 19, 1986 as -received by the Community Development Department subject to the attached conditions and the conditions attached to Subdivision 6872. 2. Residences shall be similar in size and design as those constructed in the adjacent Subdivision 6840. Revisions to these design ~shall be subject to the review and approval of the Zoning Administrator. 3. Building heights shall not exceed 35 feet. 4. The applicant shall submit for the review and approval of the Zoning Administrator a detailed landscape pian in conformance with the County Water Conservation policies. These plans shall include: A. The species, size and location of all proposed landscaping. A minimum of 25 street trees shall be included in this plan. B. The type and location of all sprinkler and lighting systems. C. The size and location of any fences. A cyclone fence along the north property line between this subdivision and the Contra Costa Canal is required. 5. At least 30 days prior to the filing of the final parcel map, the applicant shall submit at least 3 proposed street names and numbers to the Community Development Department Graphics Division for review and approval . 6. Construction shall be limited to the hours of 8:00 A.M. to 6:00 P.M. The applicant shall explore the possibility of a temporary access from Brown Road for construction traffic and/or ensure adequate precautions are taken in moving equipment through the existing Wood Glen Development. 2/13/87 DPII/3058-86C.KK _- I EXHIBIT B REVISED CONDITIONS OF APPROVAL FOR SUBDIVISION 6872 . 1. This subdivision tentative map is approved as generally shown on the tenta- tive map dated as received by the Community Development Department on October 13, 1986. 2. This subdivision shall be contingent upon approval of the rezoning request (2700-RZ) from the existing A-2 to P-1. 3. Prior to recording the final map or issuance of Building Inspection Depart- ment permits, submit a preliminary geotechnical report for review and approval of the Community Development Department. Allow 45 days for review. 4. The applicant shall submit landscape plans for the review and approval of the Zoning Administrator. These plans shall conform to Contra Costa County Water Conservation policies. 5. All utilities shall be placed underground. 6. Prior to the filing of the Final Map, the applicant shall provide name(s) for the proposed internal street. 7. Comply with drainage, road improvement, traffic and utility requirements as follows: A. In accordance with Section 92-2.006 of the County Ordinance Code, this subdivision shall conform to the provisions of the County Subdivision Ordinance (Title 9) . Any exceptions therefrom must be specifically listed in this conditional approval statement. Conformance to these requirements will be as required by the Contra Costa County Flood Control and Water Conservation District. B. Relinquish abutter's rights of access along all curb returns within the subdivision. C. All interior subdivision streets shall be dedicated to the County and constructed to County public road standards. D. Comply with the requirements of the Bridge/Thoroughfare Fee Ordinance for the Oakley Area of Benefit as adopted by the Board of Supervisors. E. Comply with the requirements of the Bridge/Thoroughfare Fee Ordinance for the East/Central County Travel Corridor Area of Benefit as adopted by the Board of Supervisors. F. Prevent storm drainage, originating on the property and conveyed in a concentrated manner, from draining across the sidewalks and driveways. G. Furnish proof to the Public Works Department, Engineering Services Division, of the acquisition of all necessary rights of entry, permits I - . -2- and/or easements for the construction of off-site, temporary or permanent, road and drainage improvements. H. Comply with the drainage fee requirements for Drainage Area 30A as adopted by the Board of Supervisors. 8. The applicant shall pay the amount of the newly established park dedication fee if acted upon within 45 days of the efective date of this permit, or the fee required by ordinance at the time the building permit is issued. 9. On the provision of police service, the applicant agrees to vote their property into a "special tax area" for police service at an initial level of $100 per parcel annually. This amount shall be adjusted yearly according to the Bay Area CPI. Furthermore, the Board of Supervisors shall review the assessment amount and adjust it to a higher level as conditions warrant it. Comply with the following advisory conditions: 1. Building Inspection Department: A. Grading permit is required. Subject grading plans prior to the initiation of any development activity. 2. Health Services Department: A. Connect to Oakley Water District. B. Connect to Oakley Sanitary District for sewer service and provide a sewer line to service lots designated as 1, 2, and 3. 3.
