SUBJECT: Implementation of Proposition 65 in Contra Costa County Wormy
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
1. RECOMMENDED ACTION:
Accept report from Health Services Department regarding implementation of
Proposition 65 including hazardous material incident notification procedures to
and within Contra Costa County.
II . FINANCIAL IMPACT:
None.
III . REASONS FOR RECOMMENDATION/BACKGROUND:
In response to Board of Supervisors Order dated 2/3/87, this report summarizes
action to date to implement Proposition 65 in Contra Costa County.
The following chronology details the development of the Proposition 65 notice
and reporting protocols within this county.
February 3, 1987 - Board designated Dan Bergman, Assistant Health Services
Director, Environmental Health Division, as the primary contact person to
receive notifications pursuant to Proposition 65.
March 20, 1987 - County Health Services Director, the Director of the County's
Office of Emergency Services and representatives of the County Fire Protection
District completed a review of notification procedure relative to Proposition
65, including hazardous material incident notification procedures to and within
Contra Costa County. (Enclosure 1)
March 23, 1987 - The Office of Emergency Services compiled a report of notifica-
tions received January 1 - March 19, 1987 pursuant to Proposition 65. These
reports were reviewed by Occupational Health/Hazardous Materials staff and no
significant incidents were reported to the county that met the requirements for
notifying the media. (Enclosure 2)
May 12, 1987 - The Board of Supervisors notified state agencies of the Contra
Costa County Proposition 65 protocol . (Enclosure 3)

Presently, the County Health Department receives all Proposition 65 notifica-
tions. Technical staff in the Environmental Health Division review all notifi-
cations for environmental and public health risk. Media notification is made by
the Health Officer, using the County Clerk press box, if and when the incident
involves a significant health threat. Draft guidelines for hazardous material
releases requiring media notification were developed by the California Health
Officers Association and are presently being reviewed by Hazardous Materials
staff for implementation.

As a result of meetings with the County Administrator's Office ,
Health Services Department , the Office of Emergency Services,
County Counsel , and the District Attorney's Office, it was agreed
that existing hazardous materials incident notification
procedures will be amended. The Board of Supervisors , in
responding to Proposition 65 (Prop 65 ) mandates , has designated
the Health Officer as the primary contact point . in County
government to receive hazardous materials notifications, with Dan
Bergman, Environmental Health Division Director, serving as the
Health Officer's designee. We have now agreed to modify existing
notification protocols as follows:
A . Prop 65 notifications will be directed to Health Services
Department , Environmental Health Division. Emergency
notifications by designated officials will be made to (415)
372 - 2286 during working hours , and to Sheriff ' s
Communications , ( 415) 372-2441 , (Comm 7 ) after normal
working hours. Non-emergency reports from designated
government officials (see attachment 1 ) will be mailed to:

Prop 65 notifications to the Board of Supervisors will be
made by Office of Emergency Services ( OES) through their
twice weekly reports, and the Health Officer will notify the
media after determining which Prop 65 notifications meet the
criteria for public notice.
B . Emergency field response notification will ultimately be
directed to the Health Services Department Toxics Unit at
( 415 ) 372 - 2286 during working hours , and Sheriff ' s
Communications , ( 415) 372-2441 (see attachment 2 ) after
working hours. However, until the Toxics Unit is relocated
and additional resources (base station, clerical , etc.) are
in place , general public and industry hazardous materials
notificaions will continue to be made to OES at 228-5000
. using the protocols in the AB 2185 Area Plan. When the
Toxics Unit becomes the central contact point for public and
industry notification, the AB 2185 Area Plan will be amended
to reflect the new procedure.
To support these notification requirements , Health Services
Department (HSD) proposes to utilize locally prepared incident
forms which provide tracking of Prop 65 notifications ( see
attachment 3 ) . Also, HSD has developed criteria to be used in
determining when the Health Officer will notify the media (see
attachment 4 ) .
In addition, the existing hazardous materials response protocols
are required with the following determinations :
o During regular working hours , when HSD EH (Environmental
Health Division) is notified of a hazardous materials
incident , EH will call or notify the Office of Emergency
Services .
o County OES will continue to be notified after hours by
Sheriff's Comm 7 of hazardous materials field response
requests directed to HSD EH staff.
o County OES shall continue notification of hazardous materials
incidents in a timely manner , to State OES and other
government agencies as they deem appropriate.
o County OES will continue to provide EH Division field
responders with additional resources in those cases where
resource enhancements become necessary.
o County OES will continue to be the central receiving office
for all incident reports prepared by responding agencies .
o County OES will continue to pursue cost recovery from
identified responsible parties in those cases where EH cost
recovery efforts prove unsuccessful in whole or in part.

B. Notify Contra Costa County Health Services Department immediately of any
incident that presents public or environmental health endangerment by phone
415-372-2286, Monday thru Friday, 8:00a.m, to 5:00p.m. , or Sheriff's
Communications 415-372-2441 after hours. Provide an essential statement of
the release or threatened release and follow up with a written memo
within 72 hours to:

C. For those incidents where in your staff's professional judgment, field
response to the incident is required immediately due to probable public or

response is not required, the notification of incidents may be mailed
within 72 hours.

CRITERIA FOR NOTIFICATION OF A DISCHARGE
PURSUANT TO PROPOSITION 65
1 . Discharge has resulted in an injury or will likely result in
an injury to a person or persons.
2 . Discharge has required an evacuation to be ordered or public
access to be restricted. Such evacuations or restrictions
of public access are due to an immediate threat to public
health and safety posed by inhalation of or physical contact
with hazardous chemicals .
3 . Discharge poses a public health or safety hazard as reported
by the fire district.
4 . Discharge has contaminated food or crops.
5 . Discharge which could result in the inhalation of a
hazardous chemical in excess of 1 % of the Threshold Limit
Value (TLV ) . (TLV's have been developed by the American
Conference of Governmental Industrial Hygienists at levels
to prevent adverse health risks to workers over an 8 hour
day. One percent ( 1 %) of the TLV provides a safety factor
to protect sensitive members of the population.)
Under special circumstances, medical experts may advise that
a lower level of the TLV may pose a substantial injury to
public health. Such discharges would also be notified.
For chemicals without TLV's, those levels exceeding the best
available health data or the levels advised by medical
experts would be notified.
6 . Discharges which could result in physical contact by the
public which best available health data indicate could cause
damage to the skin ( e. g. , dermatitis , burning) or could be
easily absorbed through the skin.

Proposition 65 - Criteria
7. Discharges which contaminate domestic water supplies in
levels exceeding State Drinking Water Action Levels (AC) or
Federal Maximum Contaminant Levels (MCL). Levels of
contamination would have to be confirmed by laboratory
analysis on two positive samples .
(Action levels are based on an excess cancer risk not to
exceed one (1 ) in a million for a 70kg person drinking two
( 2 ) liters of water a day for 70 years or on chronic
toxicity for which SNARLS [ Suggested No Adverse Response
Levels] for chronic toxicity have been developed. )
For discharges of hazardous chemicals for which no AL or MCL
exist discharges willbe notified if the chemical is a
carcinogen, or if review of best available health data
indicates a potential hazard or if advice of medical
or health experts indicates a potential public health threat
is posed.
8 . Discharges which contaminate recreational waters in any
concentration due to hazards posed by physical contact or
bioaccumulation by organisms consumed by humans.
9 • Discharges which contaminate nonrecreational surface waters
will be notified if there is a likely possibility of public
contact or bioaccumulation by organisms consumed by humans .
10 . Discharges which the Health Officer believes are likely to
cause a substantial injury to public health and safety, or
the environment.
Discharges Not To Be Notified
1 . Discharges which are already public knowledge within the
locality affected.
2 . Discharges which are the subject of an ongoing criminal
investigation.

On February 3, 1987 the Board of Supervisors designated Dan
Bergman, Assistant Health Services Director/Environmental Health,
as the Contra Costa County official to receive notifications of
illegal discharges and threatened illegal discharges in
accordance with Proposition 65 (Health & Safety Code Chapter 6.6 ,
Safe Drinking Water and Toxic Enforcement Act of 1986) .
I Recommended Action
A letter, signed by the Chair, Board of Supervisors, be
mailed to State agencies advising them of protocols to ensure
proper notification is made to Contra Costa County.

III Reason for Recommendation
A . Up to the present time, notifications by State agencies
have been made to the Board of Supervisors, Chair of
the Board, the Health Officer, Office of Emergency
Services, and to Dan Bergman, Assistant Health Services

B . State agencies must be advised of the Proposition 65
designee to receive Proposition -65 notifications.
IV Consequences of Negative Action
Reports will not be submitted directly to the central County
contact person, resulting in confused, ineffective and possible
duplicative notice to the County. Current notice procedures can
also result in possible response delays to releases and
threatened illegal releases.
