SUBJECT: PRIORS BAIL ENHANCEMENT DISTRIBUTION AGREEMENT WITH CITIES V
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDED ACTION:
Approve, and authorize the County Administrator or his designee to execute on behalf of
the County, agreements with the cities in Contra Costa County for the purpose of adjusting
division of fines and forfeitures generated by prior conviction enhancements.
FINANCIAL IMPACT:
These contracts will allow the county to retain 507 of the revenue attributable to the
priors bail enhancement portion of revenue on traffic citations issued by city police
agencies, in lieu of the Section 1463PC statutory splits which vary from 57 to 247. The
County general fund will increase $100,000 per year and the road fund will increase
$15,000 per year. The contracts continue indefinitely unless terminated by a city or the
County.
REASONS FOR RECOMMENDATIONS/BACKGROUND:
Three years ago, the municipal courts were able to negotiate agreements with the cities
and County to adjust the revenue splits on prior bail enhancements to fund the development
of the automated traffic citation processing system. The funds generated by that project
successfully recovered the $362,000 cost of the system by the conclusion of the three-year
agreements.
As traffic citation activity and the resultant workload impact on the. courts continued to
increase over the past years, the court has sought new funding to meet personnel needs.
In participation with the city managers, the municipal court developed agreements which
may be viewed as a major breakthrough in city/county cooperation. Simultaneous with the
implementation of these new agreements which will create a permanent 507 County share of
the revenue on priors bail and fine enhancements, the judges of the court will initiate a
24-month eligibility period for priors in lieu of the present 12-month period. The
consequences of . these two actions will serve to financially benefit both the County and
the cities. Sufficient new County revenue will be generated to fund additional clerical
positions in all four courts and the cities will receive more revenue under the program
package than they would otherwise receive under Section 1463 PC in the absence of such
agreements.
CONSEQUENCES OF NEGATIVE ACTION
The failure to execute these contracts would result in the County receiving substantially
less and the cities minimally less monies from priors revenue. Without this new revenue,
the municipal courts would need other funding to re cov the cos of new clerical
positions.
