Cisterman Contra Director of Personnel Costa DATE: June 4, 1987 County SUBJECT: Delegated Authority for Position Adjustments SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RESOLUTION NO: 87/397 The Contra Costa County Board of Supervisors RESOLVES THAT: 1. Delegation. To give the County greater flexibility and speed in scheduling the work of its Licensed Vocational Nurse II 's, Psychiatric Technicians and Exempt Medical Staff Physicians by simplifying the fixing of the hours of such positions, which is necessary to increase the schedul- ing efficiency, as recommended by the County Administrator, this Board hereby delegates to the Director of Personnel the authority to establish the hours of those positions, as limited herein. 2. Total Hours. This Board hereby creates for the department listed below the number of Licensed Vocational Nurse II , Psychiatric Technician and Exempt Medical Staff Physician positions indicated with the collective maximum hours per week shown. The Director of Personnel shall allocate the number of hours to be worked by each position; but: a. The Director of Personnel shall not change the number of positions or the maximum number of allowable working hours for all such positions as specified in Paragraph 2. Beadle SUPERVISORS AND COUNTY ADMINISTRATOR Personnel Auditor - Controller BY ,DEPUTY M382/7-63 f •'.ter �:i ti Exhibit D STATE OF CALIFORNIA DEPARTMENT OF HEALTH SERVICES Prior to July 1, 1987 Language (1) It is mutually understood between the parties that this contract may have been written and executed prior to July 1, 1987 for the mutual benefit of both parties in order to avoid program and fiscal delays which could occur if the contract were executed after July 1, 1987. (2) This contract is valid and enforceable only if sufficient funds are made available by the Budget Act of 1987 for the Fiscal Year 1987-88 for the purposes of this program. In addition, this contract is subject to any additional restrictions, limitations, or conditions enacted by the Legislature and contained in the Budget Bill or any statute enacted by the .Legislature which may affect the provisions, terms, or funding of this contract in any manner, (3) It is mutually agreed that if the Budget Act of 1987 does not appropriate sufficient funds for the program, this contract shall be invalid and of no further force and effect. In this event, the State shall have no liability to pay any funds whatsoever to the contractor or to -furnish any other considerations under this contract, and the contractor shall not be obligated to perform any provisions of this contract.
