THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on June 16 , 1987 , by the following vote:
AYES: Supervisors Powers , Schroder, Torlakson, McPeak
NOES: None
ABSENT: Supervisor Fanden
ABSTAIN: None
SUBJECT: USS-POSCO Modernization Project
The Board received from Harvey E. Bragdon, Director of
Community Development, a report (copy attached) on the USS-POSCO
modernization project, recommending that the Board continue its
review and discussion on this matter to a specific date and time.
Mr. Bragdon referred to a letter received from the Contra Costa
Building Construction Trades Council requesting reconsideration of
the Board's action on April 7, 1987 relative to their appeal of the
decision of the Director of Community Development that County
Ordinance Code Chapter 84-63 does not apply to this project. He
noted that the Building Trades Council had submitted a letter to the
United States Environmental Protection Agency (USEPA) requesting
clarification of the classification of hazardous waste as applied to
the cold reduction process in the modernized USS-POSCO facility, and
that USS-POSCO had also written to the USEPA. Mr. Bragdon advised
that Tom Adams , attorney for the Building Trades Council , and Zane
Gresham, attorney for USS-POSCO, would be agreeable to having the
Board consider this matter on July 28 , 1987 ; this would allow time
for all parties and staff to review documentation submitted by the
USEPA and other technical staff on the regeneration process and
applicability of County Ordinance 84-63.
Supervisor Fanden absented herself from the Board chambers
and the discussion and voting on this matter because of stock
holdings in the applicant 's company.
Tom Adams commented on the USS-POSCO project and the
method used by the applicant in calculating the amount of waste in
the regeneration process. He expressed agreement to the July 28,
1987 date for Board consideration of the report from the Community
Development Director.
Zane Gresham commented on the position of USS-POSCO. He
advised of his agreement with the July 28, 1987 date to consider a
report from staff .
Susan Durbin, Deputy Attorney General representing John
Van deKamp, State Attorney General, submitted a letter on behalf of
the Attorney General, recommending that the Board reconsider its
decision relative to the application of County Ordinance Code Chapter
84-63 to the USS-POSCO project.
In response to the question of Supervisor Torlakson on the
status of the recent appeal filed by the Building Trades Council on
the decision of the Building Inspector to issue permits , V. J.
Westman, Country Counsel, advised that the basis for the appeals is
pertinent to the issue of whether Mr. Bragdon's interpretation of
the ordinance was proper or not.
Board members discussed the matter and agreed to the July 28
date to consider the report of the Community Development Director,
with all written material to be submitted by July 16, 1987.
Therefore, IT IS BY THE BOARD ORDERED that:

1 . July 28 , 1987 at 9: 30 A.M. is FIXED as the time to con-
sider the report of the Community Development Director
based on the submission of new or additional information
received relative to the USS-POSCO modernization project
and to determine if further consideration of the Board's
action on the application of Ordinance No. 86-100
(Chapter 84-63) to the project is justified;
2. Any additional technical data relative to the Contra
Costa County Building and Construction Trades Council
appeal of the USS-POSCO modernization project is to be
SUBMITTED by 5:00 P.M. , July 16 , 1987 , with the
understanding that there will be no new or additional
information received by the Board after this July 16
date; and
3. The Contra Costa Building Trades Council ' s appeal of
April 15, 1987 disputing whether USS-POSCO has complied
with Ordinance No. 86-100 (Chapter 84-63) and is
entitled to related building permits is set for hearing
and consideration at 9 :30 A.M. on July 28 , 1987. The
Clerk shall give the Council and USS-POSCO at least
five days written notice thereof.
