SUBJECT: Bogue Ranch Development Agreement
SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Adopt the attached Ordinance for the Bogue Ranch Development
Agreement, finding that the development is consistent within
the County' s General Plan and conditions of approval for the
Bogue Ranch Development. Further, the Board directs the
Director of Community Development to sign the agreement after
it has been duly signed by the applicant.

The Chair opened the public hearing. No one appeared to
testify. Harvey Bragdon, Director of Community Development,
presented the recommendation of the Zoning Administrator that the
Board approve the agreement with an amendment recommended by
County Counsel on Page 16, Section 5, Hold Harmless Agreement, to
make it consistent with other development agreements and Mr.
Bragdon advised that the applicant has agreed to the change. Mr.
Bragdon recommended that the Development Agreement be approved
subject to the revised page 16, section 5. The Chair closed the
public hearing. Supervisor Schroder moved to adopt the ordinance
relative to the Bogue Ranch Development Agreement with the
amendment by County Counsel on page 16, section 5. IT IS BY THE
BOARD ORDERED that the Bogue Ranch Development Agreement is
APPROVED as amended and the Ordinance implementing this action is
ADOPTED.

ORDINANCE NO. 87- 28
(Bogue Ranch Development Agreement)
The Contra Costa County Board of Supervisors ordains as follows:
Section I. The Board hereby finds that the provisions of that
certain Bogue Ranch Development Agreement between the County of
Contra Costa and Woodhill Development Company, Inc. , a copy of
which is on file with the Clerk of the Board, and which has been
recommended for approval by the County Zoning Administrator, is
consistent with the County' s General Plan and conditions of
approvals for the Bogue Ranch project.
Section II. The Board hereby approves, pursuant to the
authorization provided in Section 65864 et seq. of the Government
Code of the State of California, entering into that certain Bogue
Ranch Development Agreement between the County of Contra Costa and
Woodhill Development Company, Inc. , subject to review and approval
of the Community Development Department and County Counsel.
Section III. If any section, subsection, subdivision, paragraph,
sentence, clause or phrase of this ordinance is for any reason held
to be unconstitutional or invalid, such a decision shall not affect
the validity of the remaining portions of this ordinance. The
Board hereby declares that is would have passed each section,
subsection, subdivision, paragraph, sentence, clause or phrase of
this ordinance irrespective of the unconstitutionality or
invalidity of any section, subsection, subdivision, paragraph,
sentence, clause or phrase.
Section IV. EFFECTIVE DATE. This ordinance becomes effective 30
days after passage and within 15 days of passage shall be published
once with the names of supervisors voting for and against it in the
Contra Costa Times, a newspaper published in this County.
