BoAR® OF SUPERVISORS FROM: Supervisor Sunne Wright McPeakCwtra Introduced April 28 , 1987 for Action on CostaDATE: May 5, 1987 0@ Cj0"" "7 SUBJECT: Establishment of Appropriate Fee and Policy for Use of County Buildings by Film Industry SPECIFIC REQUEST(S) OR RECOMMENDATIONS) a BACKGROUND AND JUSTIFICATION RECOMMENDATIONS Request the County Administrator' s Office and General Services Department to develop a reasonable, fair, competitive permit fee and appropriate policy for use of county facilities by the film industry. Such a permit fee should incorporate the approach of a reasonable initial charge plus actual expenses. The reasonable policy should encourage coordination with the City of Martinez for use of county facilities in Martinez and should give the county the discretion to withhold a permit if the subject film is pornographic or promoting a viewpoint contrary to county policy. Further, the Board of Supervisors commends County Administrator Phil Batchelor and the General Services Department for responding promptly to the requests of Lucas Films to use the County Courthouse in a recent location filming. BACKGROUND California is losing $1 billion annually to out-of-state locations for use by the film industry. A significant contributing factor to this negative economic trend is the amount of resistance and red tape at the local level for location filming. The California Public-Private Partnership Commission ( sponsored by CSAC) completed in 1986 a joint effort with the. Department of Commerce and California Film Council to retain the film industry in California by attracting film production to counties. It was important for Contra Costa County and the City of Martinez to respond positively when put to the test. Phil Batchelor, in particular, is to be commended. The experience, however, with Lucas Films points to the need for a uniform policy. Other jurisdictions use the approach of a reasonable initial fee ( about $200) plus actual expenses to secure a permit. In addition, it is important for Contra Costa County to adopt an appropriate policy to give us the authority to deny use of County facilities for pornographic films or films which would promote or glorify a viewpoint contrary to county policy. This should be carefully worded since a film might address issues the county is concerned about without promoting or glorifying them.
