Sec. 8320) RESOLUTION OF INTENTION TO VACATE A PUBLIC STREET The Board of Supervisors of Contra Costa County RESOLVES THAT: Pursuant to Chapter 3 , "General Vacation Procedure, " of Part 3 of Division 9 of the Streets and Highways Code, This Board declares its intention to vacate a portion of the County street commonly known as Shell Avenue and also known as Yosemite Avenue, more particularly described in attached Exhibit "A" . This proposed vacation is generally located in Vine Hill in the Martinez area. A map of the portion to be vacated is on file in the Public Works Department. This Board will meet on Tuesday, June 2 , 1987 at 10: 30 a.m. in its Chambers, Administration Building, 651 Pine Street, Martinez, California, to hear evidence offered by any interested party as to whether this is unnecessary for present or prospective public use. This Board DIRECTS the Clerk to have a copy of this resolution of intention published in a newspaper of general circulation published and circulated in this County, which is selected as the newspaper most likely to give notice to persons interested in the proposed vacation, for at least two successive weeks before the hearing in accordance with Streets and Highways Code, Sections 8320 and 8322 . Said notice shall be posted conspicuously along the line of this proposed vacation at least two weeks before the hearing, in accordance with Streets and Highways Code, Section 8323 . thereby certify that this is a true and correct copy of Orig. No. V1945 EXHIBIT "A" A portion of Yosemite Avenue as shown on the Map of Martinez Land Company Tract Number 6 filed February 8, 1916 in Book 14 of Maps at page 297 Records of Contra Costa County, California, described as follows: Beginning at the southeast corner of Lot 3 of Block 37 of said map (14 M 297) being also the rsterly line of Yosemite Avenue; thence along said westerly line north 7 12' 00" west 180.29 feet to a point of cusp from which a radial line of a curve concave to the northeast having a radius of 175.00 feet bears north 820 47' 57" east; thence southeasterly along the arc of said curve through a central angle of 470 29' 34" a distance of 145.06 feet to a point of cusp from which a radial line of a curve concave to the southeast having a radius of 10.00 feet bears south 350 18' 23" west; thence southwesterly along the arc of said curve through a central angle of 1320 30' 23" a distance of 23.13 feet to a point on the easterly line of said Yosemite Avenue; thence along said easterly line south 70 12' 00" east 68.07 feet; thence southerly along the arc of a tangent curve having a radius of 170.00 feet through a central angle of 180 13' 14" a distance of 54.06 feet to a point on Shell Avenue from which a radial line of a curve concave to the northwest having a radius of 384.29 feet bears north 350 11' 06" west; thence southwesterly along said curve through a central angle of 90 19' 48" a distance of 384.29 feet to a point on the westerly line of Yosemite Avenue from which a radial line of a curve concave to the west having a radius of 130.00 feet bears north 600 23' 07" west; thence northerly along the arc of said curve and westerly line through a central angle of 360 48' 5311, a distance of 83.53 feet; thence tangent to said curve north 70 12' 00" west 24.16 feet to the point of beginning. RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the Streets and Highways Code, the easement and right at any time, or from time to time, to construct, enlarge, maintain, operate, replace, remove, and renew those existing and in place utilities, as of the date of recording this instrument, in, upon, over and across any highway or part thereof proposed to be abandoned, including access to protect the property from all hazards in, upon, and over the area herein before described to be abandoned.
