SUBJECT: Conveyance of Replacement Sewer Easement to Central Contra Costa Sanitary
District, Across Former Southern Pacific Right of Way, Walnut Creek Area
Project No. 7520-6BB636
SPE=C REQUIST(S) OR RECONMM=CN(S) & BA Nn AND JUSTIFICATION
1. Recommended Action:
A. APPROVE the conveyance of a replacement sewer easement to Central Contra
Costa Sanitary District across a portion of the former Southern Pacific
Railroad right of way, now owned by the County.
B. FIND that the conveyance of the sewer easement is in the public interest and
will not substantially conflict or interfere with the County's use of the
property, pursuant to Govenmient Code Section 25526.6.
C. AUTHORIZE the Chair to execute the Grant of Easement on behalf of the
county.
D. AUTHORIZE the Public Works Director to arrange for the transfer of $500 to
Contra Costa County from County Flood Control District funds for the above
project.
2. Financial Impact:
The County will receive $500 for the conveyance of the easement.
3. Reasons for Reoa®endations-
To further a spirit of cooperation between public agencies and to provide
necessary property rights for the replacement sewer line.

4. Backgro�mi:
Contra Costa County acquired the former Southern Pacific Railroad right of way in
the Walnut Creek area for multiple uses. The San Ramon Creek Bypass flood
control project within said right of way requires relocation of a sanitary sewer
pipeline and conveyance of a replacement easement across said right of way to
Central Contra Costa Sanitary District.
5. Consequences of Negative Action:
Possible inverse condemnation lawsuit.
