SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION-
Adopt a position of support for AB 2047 by Assemblyman Katz which
would take additional steps to protect the personal property of
patients confined to nursing homes.
BACKGROUND:
Existing law does not make long-term health care facilities
liable to reimburse the patient for personal property which is
lost or stolen. Assemblyman Katz has introduced AB 2047 which
would hold a long-term health care facility liable for a
patient' s property if they fail to make reasonable efforts to
safeguard the patient' s property. AB 2047 would also establish a
rebuttable presumption that the facility has taken reasonable
efforts to safeguard patients ' personal property if they do all
of the following:
1 . Establish a documented theft and loss program designed to
reduce theft and loss, including orientation for its
employees on the policies and procedures.
2. Documentation is maintained on all theft or loss of
patients ' personal property and is made available to
specified agencies on request.
3 . A report is made to the local law enforcement agency within
36 hours whenever patient property with a value of $100 or
more has been stolen.
4 . A secured area for patients ' property is maintained and
available for safekeeping of patients ' property.
5 . Other specific measures are taken in accordance with
regulations adopted by the State Department of Health
Services.

Assemblyman Katz has written to the County requesting support
from the Board of Supervisors for AB 2047 . Assemblyman Katz
points out that facilities currently are required only to make a
"reasonable effort" to safeguard personal property, although the
term "reasonable effort" is not defined in law.
AB 2047 to the extent that it assists in protecting the rights
and property of patients is consistent with previous Board
policies on the need to improve the condition of nursing homes
and long-term health care facilities and protect patients. It
is, therefore, recommended that the Board support AB 2047 .
