HomeMy WebLinkAboutMINUTES - 05261987 - 1.16 To: BOARD OF SUPERVISORS FROM: Phil Batchelor Contra County Administrator Costa DATE: May 20, 1987 COu,�� }�� �� � SUBJECT: ��YY Legislation: Senate Bill 328 (Bill Greene) SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATION- Adopt a position of support for SB 328 which clarifies that case management responsibility for emotionally disturbed children, who are also dependent children of the court, rests with the welfare department, and which specifies the services which shall be provided to those children. BACKGROUND: Under existing law, it is the joint responsibility of the Superintendent of Public Instruction and the Secretary of Health and Welfare to insure maximum utilization of all state and federal resources to provide handicapped children with a free, appropriate public education and related services. Existing law also designates the County Mental Health Department as the lead case manager when a handicapped child' s individualized education program calls for residential placement of the child. This has created a jurisdictional problem since when such a child is also a dependent child of the court, the Social Service Department is vested by the court with responsibility for making placement decisions regarding the child. Senator Bill Greene has introduced SB 328 which would clarify that case management responsibility rests with the welfare department when a handicapped child is also a dependent child of the court. SB 328 also clarifies that a handicapped dependent child of the court who is severely emotionally disturbed is entitled to the full range of services available for all handicapped children who are not dependent children of the court. Finally, SB 328 specifies that the county' s costs associated with the development of individualized education programs for severely emotionally disturbed children, their placement costs in out-of-home care facilities, and the provision of supportive services to those children, shall be fully funded by the state. It is also important in clarifying what services are available to these children and in specifying that the cost of providing services to these children is a state responsibility. The Director of Social Services recommends that the Board support SB 328 and this office concurs in that recommendation.
