Bragdon', �iCXltt"4 Director of Community Development cost DATE: April 7, 1987 calls J SUBJECT: Hearing on Rezoning Application 2649-RZ to rezone approximately 30 acres of an 111 acre parcel from Exclusive Agricultural (A-80) to Exclusive Agricultural (A-20; 20 acres) and General Agricultural (A-2; 10 acres) and Minor Subdivision #94-86 to subdivide 111 acres into four parcels filed by Gene Broadman in the Tassajara area. SPECIFIC REQUEST(S) OR RECONMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Accept the environmental documentation as adequate. I 2. Approve Rezoning Application 2649-RZ as recommended by the San Ramon Valley Regional Planning Commission. 3. Adopt the San Ramon Valley Regional Planning Commission's findings as se'"t forth in its Resolution No. 12-1987(SR) as the determination ,for this decision. u� 4. Introduce the Ordinance giving effect to the rezoning application of12649-RZ as recommended by the San Ramon Valley Regional Planning Commission, waive reading and set date for adoption of s 'ame. 5. On recommendation of Supervisor Schroder, IT IS BY THE BOARD ORDERED that Ordinance No.1' 87-32 giving effect to the aforesaid approved rezoning applicatiipn is INTRODUCED, reading waived and June 2, 1987 is set for the adoption of same. This application is approved for four parcels as generally shown on the tentative map accompanying the application. Prior to filing of a parcel map, a revised map will be submitted for the review and approval of the Zoning Administrator. The boundary lines shall be adjusted to provide at least 20 acres for Parcel D and 5 acres each for Parcels B and C. 2. This approval is contingent on adoption of File #2649-RZ by the Board of Supervisors. 3. Prior to filing of a parcel map, the applicant shall comply with the requirements of the Health Services Department. 4. Prior to filing of a parcel map, the applicant shall comply with the requirements of the Tassajara Fire Protection District. 5. Comply with the requirements of the County Geologist as follows: Improvement plans,,; shall be based on an adequate topographic map of Parcels A, B, and C. Plans shall incorporate recommendations of a preliminary engineering geology, soil and foundation report meeting the combined requirements of Title 9, Sections 94-2.206 and 94-4.420. The report shall provide criteria for construction of access roads; structures, including retaining walls; ;;and grading, including cut and fill slope gradients, soil compaction, and drainage and erosion control . The report shall be sub- mitted for review" and approval of the Planning Geologist prior to recording a parcel map or issuance of Building Inspection Department permits. Allow 60 days for review. 6. At least 30 days prior to filing a parcel map, the applicant shall submit three alternative names for the proposed private road to the Graphics Sec- tion of the Community Development Department for review and approval . 7. Development rights for Parcels A and D shall be granted to the County for a period of 10 years from the recordation of the parcel map. This restric- tion shall be recorded on the parcel map. The proposed restriction shall be subject to prior.Zoning Administrator review and approval . The restric- tion will not preclude single family residences and accessory structures. 8. Comply with drainage, road improvement, traffic and utility requirements as follows: A. In accordance with Section 92-2.006 of the County Ordinance Code, this subdivision shall conform to the provisions of the County Subdivision Ordinance (Title 9) . Any exceptions therefrom must be specifically listed in this conditional approval statement. The following excep- tions to Title 9 are permitted for this subdivision: 1) Chapter 96-10, "Underground Utilities". 2) Section 96-14.002, "Improvement of County Streets". 2. 1, -2- 3) Section '' 914-2.006, "Surface Water Flowing from Subdivision", provided the applicant maintains the existing drainage pattern and does not dispose concentrated storm waters onto adjacent properties. B. Convey to the County, by Offer of Dedication, additional right of way on Morgan Territory Road as required for the planned future width of 60 feet and for necessary slope easements. C. Furnish proof to the Public Works Department, Engineering Services Division, of"'the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or per- manent, road" and drainage improvements, including the construction of the proposed"off-site earthen dam. D. Convey to the County of Contra Costa, by Grant Deed, the future "development" rights" over that portion of the property traversed by Cayentano Creek.
