May 13, 1987 County SUBJECT: Legislation: Assembly Bill 617 (Tanner) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position in support of AB 617 by Assemblywoman Sally Tanner. AB 617 extends the deadline for completion and submission of the draft Hazardous Waste Management Plan from December 31, 1987 to March 31, 1988 . BACKGROUND: AB 2948, which was signed into law in 1986, authorizes the County to prepare a Hazardous Waste Management Plan separate from the hazardous waste element of the Solid Waste Management Plan. In order to prepare such a plan, the County was required to notify the State Department of Health Services of their intent to prepare such a plan by March 31, 1987. The County complied with this deadline. The draft plan itself under AB 2948 must be submitted to the State Department of Health Services by December 31, 1987 based upon guidelines which the State is to issue. The State is then required to review the draft plan, return their comments to the County, . which is then required to amend the plan, as necessary, and submit a final plan to. the State by September 30, 1988. Assemblywoman Tanner has introduced AB 617 which would allow the State to extend the deadline for submission of the draft plan by three months--from December 31, 1987 to March 31, 1988 where a county shows the State Department of Health Services that the county has taken substantial steps toward complying with the draft plan. The County' s Community Development Department recommends that the Board support AB 617 on the basis that it may be difficult to meet the December 31, 1987 deadline since the State Department of Health Services has not yet published guidelines for the content of the plan. This office concurs that enactment of AB 617 would provide a needed opportunity to extend the submission deadline, if that proves to be necessary, and we, therefore, join with the Community Development Department in recommending that the Board support AB 617 .
