BENEFIT Specific Request ( s ) or Recommendation ( s ) & Background & Justification I . RECOMMENDATION 1 . Require all . new development within the Oakley General Plan Development Area that is outside the Oakley Area of Benefit to annex to the Oakley Area of Benefit and to pay the appropriate fee in effect at the time building permits are issued . 2 . Direct the Public Works and .Community Development Departments to revise the Oakley Area of Benefit to reflect the new General Plan .and to implement the Circulation Element . II . FINANCIAL •IMPACT III . REASONS FOR RECOMMENDATION/BACKGROUND The land use policy in effect when forming the original Oakley Area of Benefit has changed considerably with the new Oakley General Plan . The Public Works and Community Development Departments are planning to revise the Oakley Area of Benefit to reflect the land use allowed by the new General Plan a-nd to implement the Circulation Element; however, this process takes time. Public Works recommends that these new developments be required to annex to. the Oakley Area of Benefit. The new development allowed by the General Plan will contribute substantially to traffic problems in Oakley and should be required to pay towards mitigating their off-site road impacts . IV. CONSEQUENCES OF - NEGATIVE ACTION Negative action could result in a shortfall of funding necessary to implement the Circulation Element of the General Plan. If new developments are , not required to annex . to the Oakley Area of Benefit, they may, or may not be conditioned to mitigate their off-site traffic impacts . Requiring developments to annex will provide an equitable means to collect traffic mitigation fees .
