Accept the environmental documentation as being adequate. 2. Approve the application (2702-RZ & #3059-86) as recommended by the County Planning Commission and staff. 3. Adopt the Planning Commission' s reasons and findings as set forth in its Resolution #14-1987, as the determination for this decision. 4. Karl Wandry, Community Development Department, advised the Board that staff had met with the developer and neighbors and he presented a list of conditions that had been agreed upon, and recommended approval of the project with the additions of these conditions. Supervisor McPeak moved approval of the project with the amended conditions. Supervisor Torlakson offered an amendment to the motion to include participation in an ultimate financing plan for police services. The amendment died for lack of a second. Therefore, IT IS BY THE BOARD ORDERED that recommendations 1 and 3 are ADOPTED and rezoning application 2702-RZ and Development Plan 3059-86 are APPROVED with amended conditions attached, Exhibit A; and Ordinance No. 87-29, giving effect to the rezoning, is INTRODUCED, reading waived, and May 26, 1987 is set for adoption of same. This approval is based upon the exhibits received by the Community Develop- ment Department and listed as follows: A. Exhibit "A" - Preliminary Development Plan for a 24 Unit Planned Development scale 1 '=40' received February 17, 1987. B. Exhibit "B" - Preliminary floor plans and building elevations, received December 22, 1986 except that all buildings shall be a maximum of two stories tall . C. Conceptual landscape plan, received December 22, 1986. 2. The northerly 12 unit building shall have setbacks of 20' , 17'-6" and 15' instead of the 17' , 14'-6" and 12' proposed. 3. Sewage disposal serving the properties concerned in this application shall be provided by the Central Contra Costa Sanitary District. Each individual living unit shall be served by a separate sewer connection. The sewers located within the boundaries of the properties concerned shall become an integral part of the Central Contra Costa Sanitary District's sewerage collection system. 4. Water supply serving the properties concerned shall be by the Contra Costa Water District. Such water distribution system, located within the boundaries of the properties concerned in this application, shall become an integral part of the Contra Costa Water District'4s­ overal` -,water distri- bution system. Each individual living unit shall be served by a separate water connection. 5. Comply with the requirements of the Contra Costa County Fire Protection District including provision for water supply and fire hydrants, as deter- mined by the District. 6. The Covenants, Conditions and Restrictions (C.C.& R's) developed for this project shall include the following deed restrictions: A. No recreational vehicle, boat trailer or mobilehome shall be stored on, the site overnight. B. Limit on types and number of pets. C. This approval is based upon the exhibits received by the Community Develop- ment Department and listed as follows: A. Exhibit "A" - Final Development Plan for site done by George Dedekian, A. I .A. , received February 17, 1987. B. Exhibit "B" - Floor Plans and Typical Elevation Plans dated received December 22, 1986 except that all buildings shall be two stories tall . 2. This approval is subject to adoption of an Ordinance for the rezoning of the subject property under application 2702-RZ. Variances are approved to have "compact car" parking spaces as shown on plans submitted with the application and to have less than the minimum area for residential develop- ment. They meet the requirements of Section 26-2.006. 3. The proposed buildings shall be similar to that shown on submitted plans. Prior to the issuance of a building permit elevations and architectural design of the building and building roof material shall be submitted for final review and approval by the County Zoning Administrator. The roofs and exterior walls of the building shall be free of such objects as air conditioning or utility meter equipment, television aerials, etc. , or they shall be screened from view. The building shall be finished primarily in wood or other materials acceptable to the Zoning Administrator. 4. Comply with landscaping requirements as follows: A. A landscaping program for all areas shown on the submitted plot plan shall be submitted for review and approval of the Zoning Administrator at least 30 days prior to issuance of building permits. A cost esti- mate shall be submitted with the landscaping program plan. B. California native species shall be used as much as possible. All trees shall be 15 gallon size, all shrubs shall be a 5 gallon size. Trees should be of a drought tolerant type. C. Pool fencing shall be in compliance with county code. D. The area between the units and the north and south property lines shall be heavily landscaped with suitable trees and bushes to buffer the neighboring residents. E. The recreation building shall include a 'suitable room for gatherings, restrooms, a sink, and cupboards. It shall open out onto the pool/spa area. F. The Zoning Administrator shall review and approve fencing details and location for the project. The north and south property lines shall be fenced with a solid wood fence 6 feet high. The backyard areas of the ground floor units along the north and south property line shall be separated into individual areas by fencing. The property line fence can be reduced to 4' high within 15 feet of "C" or Deodora Streets. 2. G. Landscaping shall comply with the Contra Costa County policy on water conservation requirements for new developments. H. A row of suitable evergreen trees shall be planted along the north property line of the site to form a hedge to help visually separate the project from the neighboring properties. The row of trees/bushes shall be allowed to grow to a height of about 20 feet. At least 1/3 of the trees being planted along the north property line shall be 24" box specimen sized, the rest shall be 15 gallon sized subject to Zoning Administrator review. I . An acceptable landscape maintenance agreement shall be set up for all areas of landscaping of this project. The agreement shall provide for the prompt replacement of any dead trees or bushes. 5. If archaeologic materials are uncovered during grading, trenching or other on-site excavation, earthwork within 30 meters of these materials shall be stopped until a professional archaeologist who is certified by the Society for California Archaeology (SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity to evaluate the significance of the find and suggest appropriate mitigation measures, if they are deemed necessary. 6. The site lighting shall be of low intensity and sh-01" be deflected to shine only onto the site. The lighting of the recreational area shall be reviewed and approved by the Zoning Administrator at least 30 days prior to issuance of a building permit. 7. Each unit shall have address numbers and/or letters that are clearly visible day and night to the street in front of the unit or to the parking area. 8. Sewage disposal serving the properties concerned in this application will be provided by the Central Contra Costa Sanitary District. Each individual living unit shall be served by a separate sewer connection. The sewers located within the boundaries of the properties concerned will become an integral part of the Central Contra Costa Sanitary District's sewerage collection system. 9. Water supply serving the properties concerned shall be by the Contra Costa Water District. Such water distribution system located within the bound- aries of the properties concerned in this application, will become an integral part of the Contra Costa Water District's overall water distri- bution system. Each individual living unit will be served by a separate water connection. 10. Comply with the requirements of the Contra Costa County Fire Protection District including provision for water supply and fire hydrants, as deter- mined by the District. 3. 11. Covenants, Conditions and Restrictions shall be submitted for review with the Final Subdivision Map, subject to review by the Community Development Department. This document shall provide for establishment, ownership and maintenance of the common open space and parking, fire protection, agencies, private streets, and drainage maintenance. 12. The Covenants, Conditions and Restrictions (C.C. & R. 's) developed for this project shall include the following deed restrictions: A. No recreational vehicle, boat trailer or mobilehome shall be stored on the site overnight. B. Limit on type and number of pets. C. Limit to a maximum of 4 visitors at a time to each unit unless prior approval is granted by the homeowner's association. 13. The design, color and location of any small project sign at the entrances to parking lots shall be reviewed and approved by the Zoning Administrator. 14. Parking and driveway areas shall be paved so as to prevent ponding of water or the creation of dust. Parking spaces for use by the various units, handicapped and guest parking shall be clearly marked.. At least 45 parking spaces shall be provided on site. Other than for' handicapped parking spaces, the width of parking spaces can be reduced to eight feet. 15. There shall be two properly signed and sized handicapped parking spaces. There shall be one space in each parking lot. 16. Each unit shall have at least 50 cubic feet of protected storage space exclusive of normal closets and their own laundry facilities. 17. The roofs of the units and recreation building shall drain to the access roads or storm drains. 18. Each unit shall be provided with fire district approval smoke detectors. The smoke detectors shall be mounted on the ceilings near bedrooms. 19. The setback of the northerly building shall be 20' , 17'-6", and 15' not the 17' , 14'-6", and 12' proposed. 20. Second story decks of the 12 unit building along the north property line and the 4 unit building near the south property line shall face inward toward the 24 space parking lot. 21. A suitable trash enclosure and recycling area shall be developed for this project. The area shall be properly screened from view. 22. Comply with the requirements of the Park Dedication Ordinance. 4. 23. The two existing buildings on the site can be sold or demolished and removed. If the applicant and the Pacheco Town Council can reach an agree- ment, the house(s) can be moved to a suitable site subject to review and approval by the Zoning Administrator, for the Pacheco Town Council 's use only. Documented costs in moving the house, if it is to be used by the Pacheco Town Council , can reduce required Park Dedication fees. The Zoning Administrator may approve up to 100% reduction of the required fee based on owner contribution to moving and remodeling costs of the units. 24. Comply with drainage, road improvement, traffic and utility requirements as follows: A. In accordance with Section 82-2.014 of the County Ordinance Code, this development shall conform to the requirements of Division 914 (Drain- age) of the Subdivision Ordinance, unless exceptions are specifically granted. B. Convey to the County, by Offer of Dedication, 12 feet of additional right of way on Deodar Drive as required for the planned future width of 60 feet. C. Convey to the County, by Offer of Dedication, 5 feet of additional right of way on "C" Street as required for the.,pl,anned future width of - 50 feet. D. Construct curb, 6-foot 6-inch sidewalk (width measured from curb face) , necessary longitudinal and transverse drainage, and necessary pavement widening on Deodar Drive and "C" Street. The face of curb shall be located 12 feet from the widened right of way of Deodar Drive and 7 feet from the widened right of way of "C" Street. E. Install street lights on Deodar Drive and "C" Street. The final number and location of the lights shall be determined by the County Traffic Engineer. F. Install all new utility distribution services underground. G. Comply with the requirements of the Bridge/Thoroughfare Fee Ordinance for Pacheco Area of Benefit as adopted by the Board of Supervisors. H. Prevent storm drainage, originating on the property and conveyed in a concentrated manner, from draining across the sidewalks and driveways. I . Furnish proof to the Public Works Department, Engineering Services Division, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, road and drainage improvements. 5. J. Submit improvement plans prepared by a registered civil engineer to the Public Works Department, Engineering Services Division, for review; pay the inspection, plan review and applicable lighting fees. These plans shall include any necessary traffic signage and striping plans for review by the County Traffic Engineer. The improvement plans shall be submitted to the Public Works Department, Engineering Services Division, prior to the issuance of any building permit. The review of improvement plans and payment of all fees shall be completed prior to the clearance of any building for final inspection by the Public Works Department. If final inspection is requested prior to construction of improvements, the applicant shall execute a road improvement agreement with Contra Costa County and post bonds required by the agreement to guarantee completion of the work. 25. The developer shall work with the Community Development Department and the school district to solve the traffic problems in front of Pacheco Elementary School . 26. Site . grading, exterior construction, paving, and any other noisy construction work shall be limited to Monday to Friday, 8 A.M. to 5 P.M. These time limits can be modified by the Zoning Administrator if an emergency or hardship conditions are persent. The following statement is not a condition of approval ; however, the applicant should be aware of it prior to requesting grading or building permits. 1.
