SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position of support for AB 2519 by Assemblyman Bob
Campbell which would add a $50 assessment on to drunk driving
fines for i the Sheriff ' s criminalistics laboratory and an
additional '$50 assessment on to drunk driving fines for the
County' s alcohol programs.
BACKGROUND:
In the Board' s 1987 Legislative Program was a proposal to seek
legislation which would eliminate the $50 distribution from the
Fines and Forfeitures Fund for the criminalistics laboratory and
alcohol programs and, instead, add these same amounts on as an
additional assessment on top of the existing fine.
For example, if the current fine for drunk driving is $390, under
current law, $50 for each such conviction is transferred to the
criminalistics laboratory and $50 is transferred to the alcohol
programs. iThe proposal supported by the Board would have
authorized the court to add two $50 assessments on top of the
$390 fine thereby requiring the defendant to pay a total of $490. .
Fifty dollars ( $50) of this increased payment would go to the
criminalistics laboratory and $50 would go to the alcohol
programs. None of the basic Fine and Forfeiture Fund would be
diverted for these purposes. Therefore, while the criminalistics
laboratory and alcohol programs would not gain any funding
directly, the County and the cities would gain additional funding
because these two $50 amounts would not be removed from the Fine
and Forfeiture Fund before it is distributed to the County and
cities.
Assemblyman jCampbell has introduced AB 2519. This bill does not
accomplish what was included in the Board' s 1987 Legislative
Program. AB 2519, as introduced, adds an additional $50
assessment on top of the existing fine for the criminalistics
laboratory and for the alcohol programs and does not eliminate
the diversion of $50 from the basic fine to the?, criminalistics
laboratory and alcohol programs. Therefore, AB 2519, as

While the I Board' s original proposal provides additional
discretion and flexibility to the County and the cities, it may
not be as readily supported in the Legislature as would the
current version of AB 2519 since the current version of AB 2519
actually increases funding going to specified programs rather
than leaving the additional funding decisions at the discretion
of the Board. We are, therefore, recommending that the Board
support AB ,2519, as introduced, but also authorize the County
Administrator to attempt to obtain amendments to accomplish the
Board' s original purpose. If it isnot possible to obtain those
amendments, we believe there is sufficient value in AB 2519 as
introduced to justify the Board' s supporting it.
