THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on April 7, 1987 by the following vote:
AYES: Supervisors Powers, Fanden, Schroder, and McPeak
NOES: None
ABSENT: Supervisor Torlakson
ABSTAIN: None
SUBJECT: Appeal of John Rolf Hattam from the Board of Appeals
Decision on Minor Subdivision 16-86 in the Kensington
area.
The Board on March 24, 1987 continued to this date and time its
hearing on the appeal of John Rolf Hattam from the Board of Appeals
decision approving the application of John Rolf Hattam for Minor
Subdivision 16-86 for two lots only, with conditions, located at 32
Sunset Drive in the Kensington area.
Dennis Barry, Community Development Department, reviewed the
appeal and advised that the Planning Commission had approved. the minor
subdivision for two lots only and that Mr. Hattam was appealing that
decision and asking the Board to approve a three-lot minor
subdivision.
The Chair declared the hearing open and the following persons
aPPeared:
James Claytor, 1225 Solano Avenue, Albany, Attorney representing
Mr. Hattam, reviewed the appeal and urged the Board to allow a
three-lot subdivision.
Charles Grant, 26 Sunset Drive; Kensington, neighbor abutting the
proposed subdivision, urged the Board to not allow any further
development on the property. He spoke of the diminuition of value to
the neighbors ' property, the dangerous road configuration proposed,
the fire hazard he believed would be created because the private
narrow street and the steep terrain would preclude easy access for
fire fighting equipment, and the geological problems construction
would cause for abutting properties.
Robert Hansen, representing the Kensington Improvement Club,
advised the Improvement Club was opposed to the previous subdivision
in 1984 that divided the property into 2 parcels, stating that the
exiting lots in the immediate area are much larger that those
proposed.
Thomas Jukes, 170 Arlington Avenue, Kensington, owner of property
adjoining subject parcels on the Southeast objected to the proposal
for the subdivision.
Bettine Kuh, 50 Sunset Drive, Kensington, objected to the
proposal for the subdivision.
Ernest Kuh, . 50 Sunset Drive, Kensington, objected to the proposed
subdivision on the grounds of geological instability of the ground.
Marguerite Jukes, 170 Arlington Avenue, Kensington, reviewed the
history of the development of the property and registered her
objection to the. proposed subdivision.
James Claytor appeared in rebuttal and responded to the concerns
raised by the neighbors.
The Chair closed the public hearing.
Supervisor Powers commented that he was familiar with the area,
and this lot, and expressed concerns with respect to the access to the
parcel, the fact that it is a very steep lot, the lack of parking
places in the area and the practice of parking on private roads, and
the fact that most of the lots surrounding this subject parcel are
large lots. He commented that a Negative Declaration had been done
for this project and suggested that perhaps there should be a more
subjstantial environmental examination conducted. He concluded that
in keeping with the density, the size of the parcels, the traffic,
parking and geologic considerations, he felt there should be no
subdivision on the property and it should remain one parcel.
IT IS BY THE BOARD ORDERED THAT it hereby DECLARES its intent to
deny the appeal and the proposed subdivision MS 16-86 and DIRECTS
County Counsel and the Community Development .Department to prepare for
the Board' s consideraton appropriate findings.
