HomeMy WebLinkAboutMINUTES - 04071987 - T.2 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on April 7, 1987 by the following vote: AYES: Supervisors Powers and McPeak NOES: Supervisors Schroder and Torlakson ABSENT: Supervisor Fanden ABSTAIN: None SUBJECT: Hearings on Administrative Appeals Filed by The Building and Construction Trades Council of Contra Costa County on the Decisions of the Director of Community Development and the Director of Building Inspection. This being the time for hearing on the administrative appeals filed by the Building and Construction Trades Council of Contra Costa County on the decision of the Director of the Community Development Department on applicability of County Ordinance Code Chapter 84-63 and on the decision of the Director of the Building Inspection Department on the issuance of building permits for the proposed modernizaion project for USS-POSCO. Prior to considering the USS-POSCO matter, Supervisor Fanden had previously advised that she would not be participating in the discussion or voting on this matter because of certain financial holdings which might be construed as a possible conflict of interest. Harvey Bragdon, Director of Community Development, spoke on the issues relative to the appeal and of his decision that County Ordinance Code Chapter 84-63 (Ordinance No. 86-100) does not apply to the USS-POSCO project. Robert Giese, Director of Building Inspection, commented on his decision to issue two building permits for excavation and shoring of foundations for two building projects. Tom Adams, attorney for the appellant, 1875 South Grant, #600, San Mateo, took the position that the proposed modernization is subject to the provisions of Ordinance Code Chapter 84-63. Following presentations from Thomas Reid, Thomas Reid Associates, Box 872, Palo Alto, and Dr. Peter Russell who supported the appellant' s position, Mr. Adams urged the Board to grant the appeals. Zane Gresham, attorney for USS-POSCO, referenced the information submitted for the modernization project. Following presentations from John Gibson, Metalurgical Engineer, 2102 Seccombe Ct. , Walnut Creek, and Dr. Richard Cole, Environmental Science Associates, 760 Harrison Street, San Francisco, Mr. Gresham requested the Board to deny the appeals. The following people appeared to speak: Demetrio Quesada, representing Joint Union Management Safety Committee, USS-POSCO Industries, 4970 Driftwood Court, Oakley; Charles Simonds, 222 W. 10th Street, Antioch; Ralph Corral, 102 Rayann Drive, Alamo; Michael McMillen, 4362 Briar Cliff Road, Oakland; John Matheis, 5023 Clayton Road, Concord; Keith Scott, 1734 Campbell Street, Oakland; Noel Silk, 1230 Rolling Hills, Martinez; Nathan Kobrin, 172 Arvada Court, San Ramon; Donald L. Christian, representing the Contra Costa Taxpayers Association, 820 Main Street, Martinez; Robert Jones, representing the Pittsburg Chamber of Commerce 2010 Railroad Avenue, Pittsburg; Harold F. Downie, 131 Pebble Lane, Alamo, Executive Director, Industrial Association of Contra Costa County; David Menesini, 1608 Candelero Drive, Walnut Creek; Rick Fleming, representing the Antioch Chamber of Commerce P.O. Box 399, Antioch; Arthur M. Shelton, 41 Kensington Court, Kensington; David Nesmith, representing San Francisco Bay Chapter of the Sierra Club, 6014 College Avenue, Oakland; Mary Powell, 130 Prospect Avenue, Port Costa; Steve Roberti, representing the Central Labor Council; James Wilson, 2191 Piedmont Way, Pittsburg; The following person submitted a speaker card but did not speak: James C. Austin, 470 Garrard Boulevard, #6, Richmond; Edward Richter, 1734 Campbell Street, Oakland; Brief rebuttal presentations were heard from Mr. Gresham and Mr. Adams. All persons desiring to speak having been heard, the Chair closed the hearing. Harvey Bragdon, Director of Community Development, responded to questions from the Board. He introduced John William Morris, Jr. , Professor of Metallurgy, University of California, Berkeley who commented on his review of the proposed USS-POSCO project. Dan Bergman, Environmental Health Department, responded to concerns expressed by Board members on hazardous waste and material. Following discussion by the Board, Supervisor Powers moved to grant the appeals of the Building and Construction Trades Council. Supervisor McPeak seconded the motion. Supervisor Schroder advised that he could not vote for granting the appeal today and that he needed more time to consider the testimony and information presented. Supervisor Torlakson also advised that he would not support the motion. He commented that the Ordinance No. 86-100 _did not apply to the project. The Chair called the vote on the motion: AYES: Supervisors Powers and McPeak NOES: Supervisors Schroder and Torlakson ABSENT: Supervisor Fanden ABSTAIN: None The motion failed to carry. Victor Westman, County Counsel, preliminarily advised that the tie vote indicated that the matter was probably tabled.
