RECOMMENDED ACTION: Award bid and authorize the Executive Director of the Housing Authority of the County of Contra Costa to execute a contract with All Pro Security, 2617 Pleasant Hill Road, Pleasant Hill , CA 94523, for the provision of security services at El Pueblo, Pittsburg, as recommended by the Advisory Housing Commission. II . FINANCIAL IMPACT: The fee for provision of security services at E1 Pueblo, Pittsburg, will be $8.90 per hour for armed guards and $8.10 per hour for unarmed guards. The funds to cover the security services will be paid from funds received from HUD..under the Comprehensive Improvement Assistance Program to implement the El Pueblo modernization program and from Local Management funds. III. REASONS FOR RECOMMENDATION/BACKGROUND: On January 7, 1987, the Housing Authority issued a Request for Proposals for security services at El Pueblo, Pittsburg. At 3:00 p.m, on February 17, 1987 the bids were opened and All Pro Security, 2617 Pleasant Hill Road, Pleasant Hill , CA 94523 was the low bidder. During the regular meeting of the Advisory Housing Commission on Monday, February 23, 1987, testimony was heard from residents of E1 Pueblo complimenting Argus Security Patrol and requesting that Argus be allowed to continue as the security services provider for E1 Pueblo. After lengthy discussion and comment by the Chairperson that according to HUD regulations and the Housing Authority' s adopted Procurement Policy, the bid must be awarded to the lowest responsible bidder, a motion was made and passed on a 4-2-1 vote recommending award of the bid to Argus Security, the second low bidder. At the end of the meeting, after discussing the legality of the vote recommending award of the bid to Argus Security, the Advisory Housing Commission voted to reconsider the question and requested a legal opinion on its reconsideration of the award of the bid. Additionally, the Advisory .Housing Commission requested that the Board of Commissioners take into consideration the success, industry, cooperation and efficiency of Argus Security Patrol , the security guard service currently serving the people of E1 Pueblo. A legal opinion on the legality of the reconsideration of the vote concerning the security services contract was obtained from County Counsel and indicates that the subsequent decision to recommend the award of the contract to All Pro Security appears to be in order. County Counsel further states that the recommendation to hire All Pro may be taken to the Board of Commissioners without further action by the Advisory Housing. Commission. IV. CONSEQUENCES OF NEGATIVE ACTION: Should the Board of Commissioners elect to not authorize award of the bid to All Pro Security, the Board would have to disqualify all bids and. issue a new Request for Proposals, at considerable cost to the Housing Authority.
