HomeMy WebLinkAboutMINUTES - 04281987 - 2.6 vC. 4, THE BOARD OF SUPERVISORS OF CONTRA COSTLY COUNTY, CALIFORNIA Adopted this Order on April 28, 1 8 7 by the following vote: AYES: Supervisors Powers, Fanden, Torlakson and McPeak NOES: None ABSENT: Supervisor Schroder ABSTAIN: None SUBJECT: Carnival license for Blue Grass Festival at Delta Resort on May 1, 2 and 3, 1987 1. This matter was scheduled for reconsideration by the Board on 4-28-87 . 2 . John Gregory of the County Administrator' s Office reported that a meeting was held at 1: 45 on April 28, 1987 with the proponents of the Blue Grass Festival, representatives of the Bethel Island Chamber of Commerce, and County staff, at which meeting an agreement concerning the above-noted subject matter was reached. The agreement generally calls for application for the carnival license to be made by the Chamber of Commerce and Steamboat Productions , and requires the event to be non-profit. 3 . Silvano Marchesi, Assistant County Counsel., reported the following as being the salient points of the agreement: a. This agreement is a compromise of the lawsuit filed by the County pursuant to the Board' s 4-21-87 order (County of Contra Costa vs. Don Adams, et al. , No. 300061) ;. b. The application for the carnival license for the subject Blue Grass Festival will be made by Steamboat Produktions and the Bethel Island Chamber of Commerce; C. The applicants will submit, within 20 days after the last day of the event (May 3, 1987 ) , a financial report listing all revenues and expenses, and any revenues remaining after deducting all expenses will be donated to Scout Hall, a non-profit organization operating on Bethel Island; d. Deductable expenses include debts of Steamboat Productions from previous festivals ; e. In consideration, the County agrees to dismiss, with prejudice, the lawsuit referred to in subparagraph a, above;; f. All parties agree that nothing connected with this festival or agreement shall be used in connection with any present or future lawsuit:. 4 . Supervisor Torlakson recommended approval of the agreement and urged the sponsors and proponents of the Blue Grass Festival to work cooperatively with the County toward successfully hosting this non- profit event.. 5. Alfred A. Affinito, attorney for Don Adams, on behalf of Don Adams and other affected parties, expressed agreement with the aforementioned terms .
