SUBJECT: Day Care Facilities
SPECIFIC REQUEST(S) OR RECOMMENDATION(_S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. Request the County Administrator to review AB 2388 (Bates)
and recommend a position for the Board' s consideration.
2. Authorize the Chair of the Board to write to the State
Department of Social Services indicating the Board supports
the type of extended day care program operated7by the PTA in
the Walnut Creek School District, and urging that licensing
regulations be amended to require that only appropriate
licensing standards be required of such program. Send
copies of the letter to each city in the County; the Contra
Costa Children' s Council, and this County' s legislative
delegation.
3 . Leave this matter on referral to the Internal Operations
Committee.
BACKGROUND:
On February 24, 1987, the Board of Supervisors referred to our
Committee a letter from the Superintendent of the Walnut Creek
School District noting that the PTA and Parent' s Clubs have been
operating extended day care programs. One such program was
recently cited for operating without a license and must now apply
for a day care license at considerable cost to the program.
On April 13, 1987, our Committee met with representatives of the
day care programs at Murwood School and Buena Vista School, with
Muriel Smalheiser, a member of the Walnut Creek School District
Governing Board and with Dr. Kenneth Meinecke, Superintendent of
the District, as well as Meda Read from the County' s Social
Service Department.
Each of the schools in the Walnut Creek School District has an
extended day care program which operates on the school grounds
and is solely for the children attending that school. The
programs operate from 7 : 00 a.m. to 6: 00 p.m. for children

from Kindergarten to the 5th grade and presently enroll about 100
children. Each parent pays $2. 00 an hour for care.
There are several similar programs in other school districts in
the County.
The program which received the citation for operating without a
license is willing to apply for and obtain a license. They agree
that they should meet appropriate standards to insure that they
are providing appropriate care to the children;. However, some of
the requirements the State is trying to impose appear to be more
appropriate for a profitmaking facility operating in private
quarters than for a PTA-operated program using school facilities.
Among these requirements which do not appear to be appropriate
are the following:
o The Chair of the Board which governs the day care
program is being required to be fingerprinted, obtain a
health examination, and submit a personal financial
statement even though she has no direct contact with
the children. The group operating the program is non-
profit.

o The program cannot use the school' s multipurpose room
for as many children as the school can use the room
for.
o Day care licensing standards for the number of
restrooms that are required are different than those
required of a school. This restricts the number of
children who can be enrolled in the program.
The women operating the day care program emphasized again that
they are anxious to meet appropriate standards, but that some
consideration should be given to PTA programs operating in school
facilities which are operated on a nonprofit basis only for the
children in that school.
AB 2388 has been introduced by Assemblyman Tom Bates and may help
to alleviate this situation in the form in which it was
introduced, or might be amended to address this situation.
With the upcoming demands of the GAIN program on the available
day care resources in the County, we do not want to see anything
done that would eliminate or restrict available day care
resources. We are, therefore, making the above recommendations.
