Costa DATE: April 14, 1987 COu,� }� �- � SUBJECT; �Y Legislation: Senate Bill 592 (Morgan) SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position in support of SB 592 by Senator Rebecca Morgan which would authorize the Metropolitan Transportation Commission to adopt a resolution to be the Service Authority for Freeway Emergencies in any of the nine Bay Area counties with the concurrence of the Board of Supervisors and the City Councils of the cities having a majority of the population of cities within the County. BACKGROUND: Senate Bill 1199 (Chapter 1350, Statutes of ' 1985) became effective January 1, 1986. It authorizes a Board of Supervisors, and a majority of the cities having a majority of the population, to establish a Service Authority for Freeway Emergencies consisting of seven members. The Authority is authorized to impose an additional $1. 00 registration fee on all non-exempt vehicles registered in the county. The Authority could issue revenue bonds, using the increased registration fee as pledged revenue to repay the bonds. The basic purpose of the Authority is to implement and maintain a system of emergency call boxes and emergency mechanical service patrols on California freeways within the County. Any plan would have to be approved by the CHP and CALTRANS. Several cities have expressed an interest in establishing such an Authority in Contra Costa County. The County Administrator' s Office investigated this program with the County Public Works Department and County Risk Manager early in 1986 and eventually decided to drop the idea for the time being because of the potential liability exposure for failures of the system to work as intended, etc. Senator Rebecca Morgan has now introduced Senate Bill 592 . SB 592 authorizes MTC to adopt a resolution to be the Service Authority in any of the nine Bay Area counties it serves. Passage of SB 592 would appear to have the advantage of shifting some of the liability for operation of a Service Authority to MTC while allowing the implementation of what could be a valuable service to motorists. The Public Works Director supports SB 592 and recommends that the Board also support it.
