HomeMy WebLinkAboutMINUTES - 04211987 - 1.59 `1O BOARD OF SUPERVISORS FROM: Phil Batchelor Contra County Administrator Costa DATE: April 9, 1987 County SUBJECT: Legislation: Assembly'IBill 468 (Mojonnier) SPECIFIC REQUEST(S) OR RECOMMENDATION(-S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position of support for AB 468 by Assemblywoman Mojonnier which would authorize, but not require, the board of supervisors of any county to allow the: Sheriff, Probation Officer, or other official in charge of county correctional facilities or work furlough programs, to offer a program whereby minimum security inmates committed to a county correctional facility, and certain inmates participating in a work furlough program, may voluntarily participate in a home detention program in lieu of confinement in the county correctional facility. BACKGROUND: Existing law authorizes a three-year limited pilot project whereby a judge in a participating county may sentence a person convicted of a misdemeanor to home detention in lieu of sentencing a person to county jail. Assemblywoman Mojonnier has introduced AB 468 which, as amended March 9, 1987, would authorize the expansion of this home detention program as outlined above. AB 468 also provides that a person shall be eligible to participate in a home detention program only if one of the officials noted above concludes that the person is a fit subject for a home detention program. AB 468 also authorizes the ',,board of supervisors to prescribe an administrative fee not to ' exceed the cost of the electronic monitoring device and the cost of administration of the program, to be paid by each participant according to his or her ability to pay- The County Probation Officer has been requested by San Diego County to support AB 468 on;' -option , the basis that it is a county program and no county is required to participate in it. Mr. Buck is not presently prepared to recommend the use of electronic monitoring devices as a part of a home detention program, but CONTINUED ON ATTACHMENT: - YES SIGNATURE: �. The Chief Probation Officers Association of California have a support ±, position on AB 468, and Mr. Buck recommends that the Board of Supervisors also support the bill.
