(Collection of Fees)
The Contra Costa County Board of Supervisors as governing body of
the Contra Costa County Flood Control and Water Conservation
District ordains as follows:
SECTION I. SUMMARY. Many existing fees imposed on residential
developments require payment at the time a final subdivision map
is approved or a building permit is issued. Recent state
legislation provides that certain such fees cannot be collected
before the date of final inspection or the date the certificate
of occupancy is issued. This ordinance conforms existing
District fees to state law.
SECTION II. Payment of residential fees.. (1) Time of payment.
All fees imposed on a residential development which, by operation
of law, cannot be collected earlier, shall be paid on or before
the date of the final inspection, or the date the certificate of
occupancy is issued, whichever occurs later. "Final inspection"
and "certificate of occupancy" have the same meaning as described
in Sections 305 and 307, respectively, of the Uniform Building
Code, International Conference of Building Officials, 1985
Edition.
(2) Applicability. This section applies only to fees
collected to fund the construction of public improvements or
facilities, including but not limited to such fees imposed
pursuant to Section 12. 2 of the Contra Costa County Flood Control
and Water Conservation District Act. It does not apply to
utility service fees, fees collected to cover the cost of code
enforcement or inspection services, or to other fees collected to
pay for the cost of enforcement of District ordinances or state
law.
SECTION III. EFFECTIVE DATE. This ordinance becomes effective
30 days after passage, and within 15 days of passage shall be
published once with the names of supervisors voting for and
against it in the Contra Costa Times a newspaper
published in this County.
PASSED on April 21 , 1987 by the following vote:
AYES: Supervisors Powers , Fanden, Schroder , Torlakson , McPeak.
NOES: None .
ABSENT: None .
ABSTAIN: None.

(omitting the parenthetical footnotes from the official text of
the enacted or amended provisions of the County Ordinance Code) :

is approved or a building permit is issued. Recent state
legislation provides that certain such fees cannot be collected
before the date of final inspection or the date the certificate
of occupancy is issued. This ordinance conforms existing County
fee ordinances to state law.
SECTION II . Section 18-2.004 is added to the County Ordinance
Code to read as follows:
18-2.004 Payment of residential fees. (1) Time of
payment. All fees imposed on a residential development which, by
operation of law, cannot be collected earlier, shall be paid on
or before the date of the final inspection, or the date the
certificate of occupancy is issued, whichever occurs later.
"Final inspection" and "certificate of occupancy" have the same
meaning as described in Sections 305 and 307, respectively, of
