MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: April 21, 1987 SUBJECT: ANNEXATION OF OAKLEY RANCH SUBDIVISION 6634 AS ZONE 13, TO COUNTY LANDSCAPING AND LIGHTING DISTRICT AD 1979-3' (LL-2). Specific Requests or Recommendation(s) & Background Justification I. RECOMMENDED ACTION: 1. Find that the 1st Nationwide Network Mortgage Company ("Owner") is the owner of land described as: Parcels A,B,C,D and E (hereafter "said territory") as said parcels are shown on that certain Map entitled "Subdivision 6634 " as said Map was recorded September 11, 1986, in Book 306 of Maps at Page 23, Contra Costa County Records, and as shown in attached Assessment Diagram. 2. Accept Owner's written request and consent to annex said territory to County Landscaping and Lighting District AD 1979-3 (LL-2) for the purpose of annually assessing said territory for the cost of maintaining public landscaping benefiting the property. (Attached) . 3. Annex said territory as Zone 13 to County Landscaping and Lighting District AD 1979-3 (LL-2) in accordance with said written request and consent of Owner and without further notice or hearing or filing of an engineer' s report, all in accordance with Section 22608.1 of the Streets and Highways Code (Landscaping and Lighting Act of 1972). 4. Direct that said territory, identified as Zone 13 of County Landscaping and Lighting District AD 1979-3 (LL-2), shall be included in the levy of an annual assessment for the maintenance of 1 andscapi ng i n the f i scal year 1987-88 i n accordance wi th the annual report to be f i 1 ed and approved by this Board before August 19, 1987. II. FINANCIAL IMPACT: None to County. III. REASONS FOR RECOMMENDATION/BACKGROUND: Certain landscaping improvements have been conditioned on the development of the Oakley Ranch Subdivision in the Oakley area. To ensure the adequacy of future maintenance for these improvements without burdening county finances, the 1st Nationwide Network Mortgage Company (owner of the project) has requested and consented to the annexation of the project to the county landscaping and lighting district for the purpose of annuallly assessing the project for the cost of maintaining these improvements. The County Landscaping and Lighting District AD 1979-3 (LL-2) was formed in accordance with the Landscaping and Lighting Act of 1972 which permits the installation, maintenance and servicing of landscaping and lighting through annual special assessments on real property benefiting from the improvement. Annexation of the Oakley Ranch Subdivision to AD 1979-3 (LL-2) will provide the funds for maintenance of the public landscaping without the need for county financing.
