SUBJECT: Approve Contract Change Order No. 3 for Assessment District 1984-2, East Bates
Avenue, Project No. W.Q. 5491 , in the north Concord area.
Specific Request(s) or Recommendation(s) & Background & Justification
RECOMMENDED ACTION:
APPROVE Contract Change Order No. 3, in the amount of $57,076.65, and AUTHORIZE the
Public Works Director to execute it to compensate the contractor, Gallagher & Burk,
Inc. , for work resulting from design changes, utility design changes, and utility
conflicts during construction.
FINANCIAL IMPACT:
The project contingency funds are sufficient to cover the costs of the Change Order.
REASONS FOR RECOMMENDATION/BACKGROUND:
The cumulative total of this and previous Contract Change Orders exceed $25,000, thus
requiring Board approval . Design changes were necessitated by the actual locations of
existing utilities and other facilities, and to restore the abutting properties to
conditions equivalent to those existing prior to the start of construction.
CONSEQUENCES OF NEGATIVE ACTION:
The lack of approval would prevent payment to the contractor for the work necessary to
successfully complete the project.
