MICHAEL WALFORD, CHIEF ENGINEER DATE: April 21 , 1987 SUBJECT: Approve Prior Modification of Agreement with Southern Pacific Pipe Lines, Inc. for Relocation of Pipe Facilities, San Ramon Bypass Channel , Flood Control Zone 3B, Project No. 7520-6B8637. Specific Requests or Recommendations & Background & Justification I. RECOMMENDED ACTION: APPROVE a prior modification to the agreement executed with Southern Pacific Pipe Lines, Inc. on June 11, 1985 and AUTHORIZE the Public Works Director to execute the modification allowing award of a contract on a Force Account basis for the relocation of pipe facilities between Newell Avenue and Rudgear Road for the San Ramon Bypass Channel . II. FINANCIAL IMPACT: The estimated cost for the recommended relocation of 3,250 feet of pipe line is $180,000.00. This cost is reimbursable from the California Department of Water Resources. III. REASONS FOR RECOMMENDATION/BACKGROUND: By Order of the Board of Supervisors on June 11, 1985 , an agreement with Southern Pacific Pipe Lines, Inc. was approved for relocation of facilities necessary to construct the San Ramon Bypass Channel . The terms of the agreement indicate that relocation work will be awarded by competitive bid. It was anticipated that the portion of the Southern Pacific Pipe Line facility between Sta. 632 + 90 and Sta. 665 + 40 would not require relocation. However, initial grading operations by the Corps of Engineers' contractor have revealed soil conditions indicating a need for relocation. Approval of the modification to the agreement will allow Southern Pacific Pipe Lines to proceed immediately with the relocation work on a force account basis and avoid the four to five week delay required for bidding. The modification will also relieve Southern Pacific Pipe Lines from liability for damage to trees resulting from the relocation of the oil pipe line. VI. CONSEQUENCES OF NEGATIVE ACTION Failure to approve the supplement to the agreement will add four to five weeks to the relocation process and will result in the Flood Control District's exposure to claims for delay of the Corps of Engineers' contractor.
