RECOMMENDED ACTION Approve and authorize the Director of Community Development to execute on behalf of the County a contract with the firm of Brown and Caldwell, Consulting Engineers, in the amount of $392,975, for the preparation of an Environmental Impact Report for the IT Corporation Vine Hill Treatment Plant Modernization Project. II. FINANCIAL IMPACT The cost of the Environmental Impact Report is borne by the project sponsor, which is the IT Corporation (International Technology Corporation) . In addition to the consultant contract, the cost of EIR to the project sponsor includes a 25 percent surcharge ( $98,244) for staff administrative services for a total of $491,219. III. BACKGROUND The California Environmental Quality Act requires the prepara- tion of an EIR for a proposed project where the project is subject to a discretionary action by a California unit of government and where there is reason to believe that the proposed project would result in one or more significant (i.e. , adverse) environmental impacts. The project requires the discretionary approval of the Board of Supervisors in the form of an amended special Land Use Permit for a waste disposal facility. Several potentially significant impacts were identified by the project' s Initial Study and by responses to the project' s Notice of Preparation. The EIR consultant was selected by a competitive process established by the County. The scope of services for the EIR was developed in consultation with the staffs of the Bay Area Air Quality Management District, the State of Department of Health Services, the San Francisco Bay Regional Water Quality Control Board, the Central Contra Costa Sanitary District, and the County' s Health Services Department. V. CONSEQUENCES OF NEGATIVE ACTION Failure to execute this contract would delay the preparation of the EIR and, subsequently, the project itself. The moderniza- tion project is necessary for the Vine Hill Treatment Plant to continue to operate as a hazardous waste treatment facility when treatment ponds are phased out in accordance with County policies and State and Federal laws.
