Authorize the Chair to notify the State Department of Health Services and each city in the County that the County elects to prepare a county hazardous waste management plan pursuant to Article 3 . 5 of Chapter 6 . 5 of Division 20 of the Health and Safety Code as added by AB 2948 (Chapter . 1504, Statutes of 1986) . 2 . Authorize the Hazardous Materials Council to prepare and forward to the Board of Supervisors for approval an application for funds pursuant to Section 25135 . 8 of the Health and Safety Code in an amount sufficient to finance the preparation of a hazardous waste management plan, and to provide staffing . to the Hazardous Materials Council and Hazardous Materials Commission. BACKGROUND: In 1986, the Legislature passed, and the Governor signed, landmark legislation on the subject of hazardous waste planning at the local level. This legislation--AB 2948 by Assemblywoman Sally. Tanner--authorizes counties to prepare a hazardous waste management plan for the County in lieu of preparing the hazardous waste portion of the solid waste management plan. AB 2948 requires that counties notify the State Department of Health Services and each city in the county, by March 31, 1987, of their intent to exercise this option. Failure to so notify the State by March 31, 1987 allows one or more cities to prepare the hazardous waste management plan on behalf of the county. AB 2948 specifies the items which must be covered in the plan and the timeframe for completion of the plan, for review and approval by the cities, and for review and approval by the State. AB 2948 authorizes $10 million, upon appropriation by the Legislature, for the cost of preparing the plan. Of this money, $4 million is to be released to the counties on July 1, 1987 and $3 million more on January 1, 1988 and July 1, 1988 . AB 2948 requires that an advisory committee be appointed to assist the county in the preparation and administration of the county hazardous waste management plan. When the Board of Supervisors appointed the Hazardous Materials Commission in December, 1986 it structured the Commission so that it meets the composition required by AB 2948 for the advisory committee. The Hazardous Materials Commission, at its initial meeting on February 18, recommended the following to the Board of Supervisors: o that the Board of Supervisors notify the State and the cities that it intends to prepare a separate county hazardous waste management plan; o that the Board of Supervisors ask its Hazardous Materials Council to prepare an application for funds to allow for the preparation of the hazardous waste management plan. The Hazardous Materials Council concurs in these recommendations.
