SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position of support for AB 568 by Assemblyman Zeltner
which would authorize a peace officer to remove a vehicle from a
highway, or private property, if the vehicle has been used to
flee from or evade a pursuing peace officer.
BACKGROUND:
Existing law prohibits a person driving a motor vehicle from
fleeing from a pursuing peace officer. Various provisions of law.
also authorize peace officers to remove a . vehicle from the
highway under certain circumstances. One of these situations
does not include the ability to remove a vehicle which has been
used to flee from a pursuing peace officer where the driver has
abandoned the vehicle and left it unattended. Assemblyman
Zeltner has introduced AB 568 which would authorize a peace
officer to remove an abandoned vehicle under these circumstances.
In addition, the bill would require that the. towing and storage
fees be paid by the owner of the vehicle.
AB 568 provides additional circumstances under which an abandoned
vehicle can be removed from the highway and, therefore,. is
consistent with the Board' s directions to support legislation
which assists in the removal of abandoned vehicles. We are,
therefore, recommending that the Board support AB 568.
