Bragdon ^,�,,+� Director of Community Development l.�Utr DATE: May 31, 1989 Costa Cointy SUBJECT: Contract Amendment for Review of Acme Landfill Costs _ SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOI+ 1ENDATION 11 Authorize Chair to execute an amendment to the Consulting Services Agreement with Touche-Ross to include identification of historical users of Acme Landfill and review of the landfill disposal fee. FINANCIAL IMPACT The current contract limit for the Transfer Station Rate Regulation Program and the review of closure and post-closure costs is $130,148. The requested additional cost for this amendment is $29,210. The revised total contract payment limit is to be increased to $159,358. The additional cost will be recovered from the Acme Fill Corporation. Acme' s cost for both these projects will be considered an eligible expense to be incorporated into the rates at the landfill and transfer station. REASONS FOR RECOMMENDATION/BACKGROUND On March 21, 1989 the Board of Supervisors approved a contract with Touche-Ross to establish a rate review program which requires approval of disposal rates by the County for fees charged at the Acme Interim and Permanent Transfer Station. On April 11, 1989 the Board Authorized an amendment to the agreement to include a closure and post-closure cost review for Acme Landfill. On May 16, 1989 the Board of Supervisors requested staff to negotiate an amendment to the agreement to include identification of historical users of ' Acme Landfill and a review of the major components of the $47 per ton disposal fee, to determine if the cost components are reasonable. y CONTINUED ON ATTACHMENT: YES SIGNATugg _ RECOMMENDATION OF COUNTY ADMINISTRATOR RECOMMENDATION OF BO D COMMITTEE APPROVE OTHER SIGNATURE I 5 : ACTION OF BOARD ON .111N 1Z APPROVED AS RECOMMENDED OTHER The County Administrator informed the Board that after .meeting with representatives of the Cities and the Central Sanitary District yesterday, it was determined to request the Board to authorize additional work to learn what the profit and loss and balance sheets were for the last 10 years for Acme in order to be able to analyze what the profit levels were, if they were appropriate for the kind of business that a landfill is. The County Administrator indicated that the representatives agreed that the hearing scheduled for June 13, 1989 should be postponed to a later date when the Touche Ross report is completed. The review of the historical users will be a two-stage process. The first stage will be a brief analysis of Acme' s historical volume data to determine how much information is available and the accessibility of the information. Touche-Ross will then meet with County staff to determine if additional work should be completed. If no additional work is necessary the fees will be reduced. The second task is to review the current $47 per ton tipping fee to determine it reasonableness. Touche-Ross will review all major components of the $47 per ton tipping fee to isolate unreasonable costs or estimates. The analysis will not be an audit of Acme Fill or a detailed rate study. Supervisor Schroder' s severance of relationship with Valley Waste Management (Valley Disposal) and public commitment of the Town of Danville, the City of San Ramon and Supervisor Schroder to the Blue Ribbon Committee to work towards finding a transfer station site in the San Ramon Valley. Prior to the Board acting on items 2. 4 and 2. 5 on today' s agenda, Supervisor Schroder announced that he had severed all relationships with, Valley Waste Management (Valley Disposal) and that he had no financial or any other type of arrangement with any persons involved in any waste matter in the County; however, he had been advised by County Counsel that he should remove himself from the Chambers while the Board considers 2.4 and 2. 5. Supervisor Schroder advised that during the Blue Ribbon Committee hearings on the siting of solid waste sites, a representative of the Town of Danville and a representative of the City of San Ramon and he hadiappeared before the Blue Ribbon Committee and committed publicly that the three jurisdictions would work toward the finding of a transfer station site in the San Ramon Valley if it were necessary and it was determined necessary by the Solid Waste Commission and by the Cities that such a solid waste transfer station was necessary in the San Ramon Valley.
