MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: June 6, 1989 SUBJECT: MODIFY CONDITIONS OF APPROVAL FOR SUBDIVISION 7075 Specific Request(s) or Recommendation(s) & Background Justification I. RECOMMENDATION Modify conditions of approval 14-A3B, 14-B, and 14-C to allow the drainage from the back slope of lot 12 to drain to the Sans Crainte watershed in the same manner as lots 8, 9, 10, and 11. II. FINANCIAL IMPACT None III. REASONS FOR RECOMMENDATION/BACKGROUND On August 2, 1988 this Board approved the tentative map for Subdivision 7075 with conditions. The conditions of approval specifically allowed the back slopes of lots -8,, 9, 10, and 11 to drain through the Boyland property into the Sans Crainte watershed. The back slopes of lots 8, 9, 10, and 11, together with portions of the neighboring properties that also drain to the Boyland property, total 1.29 acres in area. Prior to the subdivision, 5.19 acres of land drained through the Boyland property into the Sans Crainte watershed. The subdivision, as approved, reduces the area draining to the Boyland property by 3.90 acres, or 75%. The tentative map for Subdivision 7075 showed the drainage from the subdivision street, Poppy Court, being collected in a storm drain line between lots 11 and 12 which then ran along the back of lots 12, 13, and 14 to Mountain View Boulevard. After the subdivision was approved, the drainage plans were finalized and reviewed by Public Works. During this process it was decided the storm drain line should not be installed between lots 11 and 12 and along the back of lots 12, 13, and 14 to Mountain View Boulevard. Instead, .the storm drain line should remain in Poppy Court and drain .directly to Mountain View Boulevard. There were three reasons for changing the location of the storm drain line. First, it would be very difficult to construct the storm drain along the back of lots 12, 13, and 14 which is at the toe of the graded slopes; second, there are many trees located on the common property line with the Graves property, opposite lot 14, which would be damaged by the installation of the storm drain line; third, Public Works policy dictates that all storm drain lines should be located in the street area, to the greatest extent possible, for ease of maintenance and ease of repair or replacement. A storm drain line along the back of lots 121 13, and 14 would be very difficult for County forces to maintain and very expensive to repair. The result, however, of changing the storm drain line from the back of lots 12, 13, and 14 to Poppy Court, is that the surface flows from the back slope of lot 12 would be added to the ditch collecting the drainage from the back slope of lots 8, 9, 10, and 11. The back slope of lot 12 is . 11 acres in area. This would slightly increase the area draining to the Boyland property from 1.29 acres to 1.40 acres, but would still be a 3.79 acre, or 73% reduction from the previously undeveloped drainage pattern. The Public Works Department recommends the conditions of approval be modified to allow the back slope of lot 12 to also drain to the Sans Crainte watershed as a result of the redesign of the subdivision storm drainage system. Continued on attachment: X yes Signature: �/���/J Action of Board on: June 6, 1989 Approved as Recommended_ Other Michael Walford, Director of Public Works, presented the staff report on the recommendation to modify conditions of approval for Subdivision 7075, explaining the need for the changes. Mr. Robert W. Jardine, 2042 Hermine Avenue, Walnut Creek, commented on a written statement which he requested be a part of the record expressing his concerns and opposition to amend any condition of approval without sufficient assurances that the rights for his property which were achieved through the due process of approval are not diminished by this action. Supervisor Schroder recommended deferring action on the matter to later in the afternoon to allow for himself, Mr. Jardine and Mr. Walford to meet and confer on the various concerns expressed by Mr. Jardine. Later that afternoon after meeting with the involved parties, Karl Wandry, Community Development Department, advised that staff would attempt to resolve Mr. Jardine' s concerns and recommended approval of the modifications to the conditions of approval. Therefore, IT IS BY THE BOARD ORDERED that the above recommendation is APPROVED; and the conditions of approval for Subdivision 7075 in the Walnut Creek area are MODIFIED as listed in the recommendation.
