NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO.89/364 SUBJECT: Continuation of Intensive Drug Testing Program WHEREAS, the Contra Costa County Board of Supervisors desires to continue a certain project designated the "Intensive Drug Testing Program" ( 87/583 ) , to be funded in part from funds made available through the Anti-Drug Abuse Act of 1988 for the Anti-Drug Abuse Program administered by the Office of Criminal Justice Planning (hereafter referred to as OCJP) ; NOW, THEREFORE, BE IT RESOLVED that the County Probation Officer is authorized to submit on behalf of the Contra Costa County Board of Supervisors, the attached proposal for anti-drug abuse purposes to OCJP, and that he is authorized to execute on behalf of the Contra Costa County Board of Supervisors the attached Grant Award Agreement for anti-drug abuse purposes, including any extensions or amendments thereof. BE IT FURTHER RESOLVED that the applicant agrees to provide all matching funds required for said project (including any extensions or amendments thereof) under the Anti-Drug Abuse Program and the rules and regulations of OCJP and that cash will be appropriated as required thereby. IT IS AGREED that any liability arising out of the performance of this Grant Award Agreement, including civil court actions for damages, shall be the responsibility of the grantee and the authorizing agency. The State of California and OCJP disclaim responsibility for any such liability. Buck, County Probation Officer Costa DATE: May 22, 1989 County SUBJECT: Continuation of Intensive Drug Testing Program SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Authorize the County Probation Officer to sign and submit on behalf of the Contra Costa County Board of Supervisors an application to the State Office of Criminal Justice Planning to continue the Anti-Drug Abuse Program known as the "Intensive Drug Testing Program" , in the amount of $121,500 . FINANCIAL IMPACT The application to continue the Intensive Drug Testing Program, if funded by the State, will not create any additional expenses for the County beyond that provided for in the FY 1989-90 budget. This application, if funded, will generate $121, 500 in revenue for the County. These dollars will be allocated as indicated above, and have been anticipated in the recommended budget for FY 1989-90. Should this project be funded, the Probation Department will be responsible for submitting demands to the State for costs incurred. This application is for the period of July 1, 1989 to December 31, 1989. There is a match fund requirement of $13,500. BACKGROUND This block of monies, which the Office of Criminal Justice Planning is administering, represents Federal dollars appropriated by Congress in the Anti-Drug Act of 1988, pursuant to Public Law 99-570. The purpose of this program is to assist units of local government in the apprehension, prosecution, adjudication, probation and pre-trial services of drug offenders. The original grant, authorized by Board Resolution No. 87/583 , was for the period January 1, 1988 to December 31, 1988. The original grant was extended to June 30, 1989. This project targets mid-level and street-level adult and juvenile drug offenders from throughout Contra Costa County who are placed on probation. Five specialist Probation Aides were hired with project funds. They are assigned 25 adult and/or juvenile cases each by Deputy Probation Officers for the purpose of drug testing and other surveillance type contacts with targeted offenders. The Aides are under the direct supervision of Probation Supervisors. CONSEQUENCES OF NEGATIVE ACTION Failure to approve this application will make it all but impossible to continue the necessary probation supervision needed to properly carry out the orders of the courts placing these people on probation and to prevent them from further drug abuse.
