RECOMMENDATION:
Adopt a position in SUPPORT of SB 370 by Senator Robert Presley which repeals the sunset on
the current state sharing ratio for children placed in foster care and institutions.
BACKGROUND:
Following the passage of Proposition 13 in 1978,the Legislature changed the sharing ratio between
the state and counties for the non-federal share of the costs of foster care. The prior formula was
a very complex one which capped the state's participation and left the vast majority of foster care
costs as a county responsibility. This was changed to provide that the state would pick up 95% of
the non-federal cost of foster care with no cap on their participation. Counties paid the remaining
5% of the non-federal costs. This "95/5" sharing ratio contained a sunset provision which would
have allowed the prior formula to take effect again after a couple of years.
The sunset date has been extended on several occasions to prevent the formula from reverting to the
earlier,complex and very costly formula for the counties. When the sunset was last extended to July
1, 1990 the Governor commented in signing the bill that he felt this was the last extension there
should be and that the old formula should be allowed to take effect again or that some other more
equitable formula should be explored which would require greater participation by the counties. The
problem is that the cost of foster care has grown so substantially in the past ten years that the possible
shift of costs from the state to the counties now exceeds $200 million.

Senator Presley has now introduced SB 370 which repeals the July 1, 1990 sunset date and leaves
the "95/5" formula in place permanently. SB 370 was amended May 15, 1989 to add a condition
on the county's receipt of the 95%state share. The bill would require that the county report annually
to the state on the efforts that have been made to provide preplacement preventive services to abused
and neglected children. Since this county has in place a pilot project to provide exactly this type
of preventive services and since the Board of Supervisors is sponsoring AB 899 (Campbell)which
would expand this project county-wide, making this type of a report should present no problem to
the county.
We are, therefore, recommending that the Board of Supervisors indicate their support of SB 370 to
Senator Presley and actively work in support of the bill.
