I. RECOMMENDATION
ACCEPT status report from the Public Works Director.
II. REASONS FOR RECOMMENDATION/BACKGROUND
Siemens Medical Laboratories, Inc. , the applicant of Land
Use Permit 2005-88, is building a medical equipment design,
manufacturing, and sales facility in the North Concord area.
In accordance with the Countywide Area of Benefit Ordinance,
the Public Works Department collected a road improvement fee
in the amount of $371, 393 . 60 about a year ago. Siemens
appealed the fee collection, citing an agreement they had
with Bedford Properties and the City of Concord that no road
improvement fees would be collected.
On January 17 , 1989 the Board denied the appeal of Siemens
Medical Laboratories, Inc. , but directed that the Public
Works Director meet with Siemens ' representatives and City
of Concord representatives to determine what amount of fee--
if any--should be retained by the County for future road
improvements. n'

Subject: Appeal of Siemens Medical Laboratories, Inc.
(Board of Supervisors referral of 2/17/89)
The meetings were held soon thereafter and it was determined
that most of the road improvements desired by the County had
been constructed by the Bates Avenue Assessment District,
although the parcel occupied by Siemens was not within that
district. The only remaining improvements were some
signalization and widening of various roads in the area
adjacent to State Route 4. The County took the position
that we would only retain a portion of Siemens ' fee if the
City of Concord contemplated asking the County to pay a
portion of these road improvements adjacent to the freeway.
At the end of the meetings it was left that if Siemens could
get a letter from the City of Concord indicating that
Siemens did not owe Concord any area of benefit fee, and
that Concord would not expect the County to pay-any share of
the planned road improvements and signalization adjacent to
the freeway, then the County would recommend to the Board of
Supervisors that Siemens' entire fee be refunded. If,
however, the letter from the City of Concord indicated a
County responsibility for some of these improvements, the
County would retain some prorata share of Siemens ' fee.
Since those meetings we have not received such a letter and
further contact with Siemens ' attorney indicates they still
expect to obtain the letter, but they are having difficulty
working out the exact wording with the City of Concord's
City Attorney and their Public Works Department. As soon as
. we have a final resolution we will place it on the agenda
for Board approval.
