Retention, West County Justice Center, Project B
Specific Request(s) or Recommendations(s) & Background & Justification
RECOMMENDATION
APPROVE an Escrow Agreement with Walsh Construction Company and Bank of
America for security deposits in lieu of retention and AUTHORIZE the
Director, Justice System Programs to execute the agreement pursuant to
Section 22300 of the California Public Contract Code.
FINANCIAL IMPACT
There should be no financial impact on the County.
REASONS FOR RECOMMENDATION/BACKGROUND
The Construction Contract for construction of the West County Justice
Center in Richmond permits the substitution of securities in lieu of
retention in accordance with section 22300 of the Public Contract Code
( formerly section 4590 of the Government Code) . This Escrow Agreement
defines the responsibilities of the parties and the terms of release of
funds. This agreement is substantially similar to the form set forth in
Section 22300 of the Public Contract Code.
