SUBJECT: Establishment of Drainage Area 48B and the Institution of a Drainage
Plan therefor and Adoption of Drainage Fee Ordinance, West Pittsburg
Area. Project No. #7505-6F8184.
The Board of Supervisors of Contra Costa County, as the Governing Board
of the Contra Costa County Flood Control and' Water Conservation District, RESOLVES
THAT:
On February 25 , 1986, this Board adopted its Resolution No. 86/92
proposing to establish Contra Costa County Flood Control and Water Conservation
District Drainage Area 48B, consisting of that real property described in Exhibit
"A" , attached thereto, and institute a drainage plan therefor.
The Board on May 20, 1986, continued to this date the hearing on the
proposed establishment of the Drainage Area 48B, institution of a drainage plan
and adoption of a drainage fee ordinance for the West Pittsburg area. On this
date all written and oral comments, recommendations, and objections, presented
concerning the proposed Drainage Area and plans, were considered.
This Board FINDS that no valid written protests, nor written petition for
an election, signed by at least 25 percent of the registered voters within
Drainage Area 48B, have been filed.
I.t appears from the affidavits of publication on file with this Board
that all notices required to be given for such a hearing have been duly and
regularly given and all procedures have been followed in accordance with Sections
11 and 12.3 of the Contra Costa County Flood Control and Water Conservation
District Act and in accordance with the provisions of Resolution No. 86/82.
This Board has received no resolution or ordinance adopted by an
affected city requesting the exclusion of territory from proposed Drainage Area
48B.
The Board hereby CERTIFIES that the Negative Declaration, submitted to
it by the . Public Works Department as to the environmental impact of proposed
Drainage Area 48B, has been completed in compliance with the California Environ-
mental Quality Act, and said Board has reviewed and considered the information
contained therein.
This Board ORDERS that- the area expected to be developed, as shown on
Drawing No. D-12483 (Drainage Area 48B Land Use Map) of the Contra Costa County
Flood Control and Water Conservation District, be expanded to include an additional
300 acres of low density residential developments and the drainage fees be
calculated on the basis of the expanded area.

within the boundaries of Drainage Area 48B and if, within the next year, the rate
and pattern of general plan amendments, new rezoning and development applications,
.occurring within the aforementioned 300-acre area,. do not warrant said area' s
inclusion in the fee calculations, revise the drainage fees excluding said
300-acre area and present an amended fee ordinance to this Board for approval .
This Board hereby also FINDS that good cause exists for the establishment
of Drainage Area 48B and ORDERS that Contra Costa County Flood Control and Water

Conservation District Drainage Area 48B is ESTABLISHED, consisting of the real
property described in the aforementioned Exhibit "A" . The drainage plan, as .
shown on the map entitled "Drainage Area 48B, Boundary Map and Drainage Plan" ,
dated November, 1985, proposed to be instituted for Drainage Area 48B and on file
with the Clerk of the Board of Supervisors, Administration Building, Martinez,
California, is hereby INSTITUTED.
This Board REQUESTS the Chief Engineer to continue seeking federal and
other outside funds for drainage improvements in Drainage Area 48B and, when
funds become available, sufficient to reduce the drainage fees, present an
amended fee ordinance to this Board for approval .
This Board hereby ENACTS Ordinance No. 86-42 establishing drainage
fees in said Drainage Area.
This Board hereby DIRECTS the Chief Engineer to file with the County
Clerk a Notice of Determination for this Project.
