THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA

SUBJECT: Hearing to Reconsider Establishment of Area of Benefit
Bates Avenue, North Concord
The Board on May 6, 1986 continued to this date its
hearing to reconsider establishment of an Area of Benefit for the
Bates Avenue/North Concord area.
The Chair declared the hearing opened. No one appeared to
testfiy and the Chair declared the hearing closed.
Supervisor McPeak advised that inasmuch as there is now
an assessment district in place to provide for the necessary
improvements, she would recommend that the Board's previous action
of April 9 , 1985 adopting resolution 85/170 establishing an Area of
Benefit for the Bates Avenue, North Concord area be rescinded.
IT IS BY THE BOARD ORDERED that the recommendation of
Supervisor McPeak is APPROVED.

This further DETERMINES, pursuant to Streets and Highways Code
Sec. 8340(c) that the public convenience and necessity require that no
easement be reserved for existing, in-place utility facilities.
This Board declares that the hereinabove described proposed vacation
area is HEREBY ORDERED VACATED. From and after the date this Resolution is
recorded, the portion vacated no longer constitutes a public highway.
The Real Property Division is ORDERED to record a certified copy of
this Resolution in the office of the County Recorder.
