The Board of Supervisors of Contra Costa County RESOLVES THAT:
On April 29, 1986, this Board passed a resolution of intention (86/223)
to amend Resolution 85/744 , regarding the vacation of a County street, for
the purposes of deleting certain conditions set forth therein and modifying
an erroneous property description. The amended property description is
attached hereto as Exhibit "A" and made a part hereof. On that date the
-Board also fixed June 3, 1986 at 10:30 a.m. , in its Chambers, as the time
and place for the hearing on the proposed amendment, and ordered that the
April 29, 1986 resolution be published and posted as required by law, which
was done as shown on affidavits on file with this Board.
The hearing was held at that time and place, this Board hearing and
duly considering all evidence offered concerning the proposed amendment by
all interested parties. The amendment modifies the legal description
attached as Exhibit "A" to Resolution 85/744 to remove the description of a
portion of Buskirk lying within the City of Pleasant Hill which is not owned
by the County and removes the condition originally imposed by Resolution
85/744 which is no longer in the public's interest.
This Board hereby. FINDS that Resolution 85/744 should be amended to
modify the legal description contained therein and to delete the condition
that the County Street, which is subject of the vacation, be superseded by
relocation prior to the time said street is vacated.
This Board hereby determines pursuant to Streets and Highways Code
Section 2381 that the vacation is not useful as a nonmotorized transportation
facility.
This Board hereby FINDS that the public road is unnecessary for present
or prospective public use.
RESOLUTION NO. 86/ 322
This Board hereby FINDS that the proposed vacation will not have a
significant effect on the environment, and that it has been determined to be
categorically exempt from the California Environmental Quality Act under
State CEQA Guidelines Section 15312. The proposed vacation is part of a
sale of surplus government property not located in an area of statewide,
regional or areawide concern. The Public Works Director is ORDERED to
file a Notice of Exemption with the County Clerk. The Planning Commission
having filed its general plan report concerning this proposed vacation and
this Board having considered the general plan, FINDS pursuant to Government
Code Section 65402 that it has received the planning agency's report.
The Board further DETERMINES, pursuant to Streets. .& Highways Code
Sec. 8340(c) that the public convenience and necessity require that no
easement be reserved for existing,'in-place utility facilities.
This Board declares that the hereinabove described proposed vacation
area is HEREBY ORDERED VACATED. From and after the date this Resolution
is recorded, the portion vacated no longer constitutes a public highway.
The Real Property Division is ORDERED to record a certified copy of
this Resolution in the office of the County Recorder.

The Board of Supervisors of Contra Costa County RESOLVES THAT:
On April 29, 1986, this Board passed a resolution of intention (86/224)
to amend Resolution No. 85/746 regarding the vacation of the County street
described in Exhibit "A" attached hereto and incorporated herein by this
reference and fixed June 3, 1986 at 10:30 a.m. , in its Chambers, as the time
and place for the hearing thereon, and ordered that the resolution be
published and posted as required by law, which was done as shown on affidavits
on file with this Board.
The hearing was held at that time and place, this Board hearing and
duly considering all evidence offered concerning the proposed amendment by all
interested parties. This amendment modifies Resolution-'85/746 passed by this
Board December 17 , 1985, by removing conditions previously imposed which are
no longer in the public' s interest.
