SUBJECT: Concurrent Sale of Alcohol and Gasoline
In response to the request of the Board on April 22, 1986 ,
Victor J. Westman, County Counsel, transmitted a proposed ordinance
which would prohibit the concurrent sale of alcoholic beverages and
motor fuels at the same location. He advised that the proposed
ordinance is intended to apply only to businesses established after
its effective date. Mr. Westman noted that if the Board wishes to
prohibit such sales by existing businesses, it would be necessary
for county staff to (1) conduct an inventory to determine how many
such businesses currently exist throughout the County, and (2)
establish a factual basis to support a reasonable ,amortization
period (the time within which a business must stop conducting the
prohibited sales) ; following completion of these tasks, an ordinance
can be prepared applicable to existing businesses. County Counsel
recommended referral of this matter to the County' s planning com-
missions for review.
Supervisor Powers advised that he supports County Counsel' s
recommendation for referral to the Planning Commissions. He suggested
that the proposed ordinance be reviewed prospectively and retrospec-
tively, i .e. , as to how it would affect future businesses and
existing businesses.
Supervisor Fanden advised that the proposed ordinance is
endorsed by the Contra Costa County Alcoholism Advisory Board. She
suggested that the Alcoholism Advisory Committee make a presentation
on this issue to the Planning Commissions.
Marc S. Aprea, representing the Southland Corporation,
presented Board members with the written statement of David Hurtado,
a 7-Eleven Franchisee. He also submitted the study of Dr. Larry L. Berg
on the "Affects of the Concurrent Sale of Gasoline and Alcohol. "
Mr. Aprea advised that his Company would be willing to work with the
Board in developing a program to discourage drinking alcoholic
beverages and operating a motor vehicle.
Board members being in agreement, IT IS ORDERED that the
Alcoholism Advisory Board is REQUESTED to meet with representatives
of the Southland Corporation to discuss potential programs to
discourage drinking and driving.
IT IS FURTHER ORDERED that the proposed ordinance is
REFERRED to the Planning Commissions for review and public hearings,
including impact on current and future businesses selling alcoholic
beverages and motor fuels at the same location.
IT IS FURTHER ORDERED that the Alcoholism Advisry Board is
REQUESTED to make a presentation to the Planning Commissions on this
proposed ordinance.
