Yancey, District Attorney Date: May 5, 1986 Sut)ject: Addition of one District Attorney Investigator Aide position The attached P300 request to create one District Attorney Investigator Aide is required to provide a position for the Martinez office who can make personal service of subpoenas on witnesses, as required. The position is also required so that mail and confidential case files can be distributed between the three prosecutorial offices located in Concord, Martinez and Richmond. Most of the subpoenas served by our District Attorney Investigator Aides are subpoena duces tecum or standard subpoenas that are served on witnesses who we know will not honor a mail-out subpoena or ones which the Marshal's office was unable to locate or witnesses who the trial attorney decided to subpoena at the last moment. The .Martinez office has had either a temporary or CETA position handling the daily internal mail/case file run for the past 10 years. Since this office found it necessary to devise .its own system of ensuring the timely issuance of subpoenas, we have had to rely upon our own staff to ensure the personal service of subpoenas. In 1981 , this department permitted a vacant District Attorney Supervising Inspector position to be cancelled so that two Process Server positions could be created. One was assigned to the Concord office and the other was assigned to the Richmond office. These positions were subsequently retitled to District Attorney Investigator Aide. Shortly after this occured, this office adopted a 4-part Moore Business Form Mail-Out Subpoena which was designed so that it could be prepared by the Law & Justice Computerized System. During FY 84-85 we issued• a total of 66,000 subpoenas. Most of these were served by mail. We estimate that our staff made personal service on about 3,000 of these subpoenas. With the acquisition of this new position, we should have additional indepen- dence from any outside sources in serving our subpoenas. Prior to 1981 , we were totally dependent upon the Marshal 's office and local law enforcement agencies in serving our subpoenas. We now can handle most of this on our own. I believe it only proper to also state that this department has acquired this capability through our own financial means by diverting our resources as we found it necessary. We never received any additional funds in our budget for this purpose. Sufficient funds are available in our FY 85-86 budget and in our FY 86-87 budget to cover the cost of this new position. When the position is created, we intend to appoint Lucy M. Daly who has been occupying the temporary position since July 1985. Ms. Daly is number 3 on the current District Attorney Investigator Aide eligible list which is due to expire on May 28, 1986. We will be submitting a request to have this list extended in the near future. t
