May 27 , 1986 Coirty SUBJECT: Legislation: Assembly Bill 4041 (Cortese) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position of support for AB 4041 by Assemblyman Cortese. BACKGROUND: Under current law, counties are responsible for providing relief and support of all "incompetent, poor, indigent persons, and those incapacitated by age, disease, or accident, lawfully resident therein, when such persons are not supported and relieved by their relatives or friends, by their own means, or by state hospitals, or other state or private institutions" . (Welfare and Institutions Code Section 17000) . Assemblyman Cortese has introduced AB 4041 at the request of the County Supervisors Association of California. AB 4041 transfers this responsibility , to the State. Since county General Assistance programs were established in response to Welfare & Institutions Code Section 17000, AB 4041 would have the effect of transferring all General Assistance responsibility to the State. In this County, General Assistance was budgeted for the current fiscal year at $4,940,000. In view of the fact that AB 4041 would relieve the County of the General Assistance Program, it seems appropriate for the Board to indicate its support for AB 40.41.
