HomeMy WebLinkAboutMINUTES - 06031986 - 1.115 TOS' BOARD OF SUPERVISORS j � Contra FROM: Phil Batchelor, County Administrator 4i) Costa DATE: May 27, 1986 County SUBJECT: Request of Warren Smith for Authorization to Make Sales to County Employees SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Consider reaffirming prohibition on sales in County Buildings. BACKGROUND On April 28, 1986 your Board referred to our office for review the request of Warren Smith for authorization to make sales in County buildings of food items to County employees. Mr. Smith' s request is in the nature of an appeal inasmuch as a long standing County policy precludes such sales. We have reviewed the plan proposed by Mr. Smith and find that his proposal, if authorized, would work as follows: 1 . As a retailer and wholesaler ( licensed he indicates by the City of Pittsburg and exempted by the City of Martinez) , Mr. Smith proposes to order in bulk to meet packers minimums and obtain a favorable price. To help meet volume requirements, he proposes to make selective merchandise available to County employees at favorable prices. 2. Food products to be offered are items ordered from wholesalers and packers and distributed in the original sealed state with the exception of spices. The latter are proposed to be packaged in accordance with Health Department requirements. 3 . Orders are proposed to be taken from individual employees in advance using an order form (copy attached) , with the order then to be filled at selected County location( s) in County buildings. 4 . Orders would be filled on a once-a-month schedule when the merchandise would be brought to designated location( s) for pickup by the employee who ordered it and for receipt of payment. Pick up is proposed at a central County building location as the. primary point of distribution, but also be at two or three other facilities with a large number of County employees. ( If the proposal is approved, perhaps a portion of the employee area on the 12th floor of the Administration Building could be utilized on a once-a-month basis for this purpose such as from 10 :00 a.m. to 2: 00 p.m. ; this would allow for distribution during the lunch hour. ) Mr. Smith indicates that he is proposing, in part, to make the merchandise available in this way in gratitude for the overall favorable response he has had in working with County employees over the years. It is our view that the plan proposed by Mr. smith is a workable one but that if authorized, approval should be for a trial period and subject to the following conditions: 1. Development of a written agreement, or permit, with Mr. Smith setting forth the terms and conditions under which he will be allowed use of County premises. 2. Appropriate insurance coverage to protect the County against any liability which might result from the agreement. In support of his request, Mr. Smith cites sale of beverages in County facilities. Such sales clearly occur; they are covered by written agreement, however, and do provide a percentage commission to the County. Overall our conclusion is that Mr. Smith' s proposal is unlikely to have broad appeal among County employees, has no direct benefit to the County, and does have detrimental implications as . a precedent for sales by other vendors.
