BOARD OF SUPERVISORS FWW: INTERNAL OPERATIONS COMMITTEE CMra Costa DATE: June 23, 1986 CvJ ata7 SUBJECT: Issues for Cable TV Ordinance Update SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION.: Approve the issues which will be addressed in the Cable TV Ordinance update, as submitted to our Committee by the Cable TV Franchise Administrator. BACKGROUND: The Board of Supervisors has directed staff to update the Cable TV franchise ordinance to conform it to the federal Cable Communications Policy Act of 1984, and to make other related changes as may be. considered appropriate. On June 23 , 1986 our Committee met with Sara Hoffman, Franchise Administrator, and David Schmidt, Deputy County Counsel, and reviewed the attached list of issues staff intends to pursue with the Board' s approval. Our Committee agrees that this is an appropriate list of issues to be addressed with the cable companies in revising the County' s ordinance, and that staff should proceed with the ordinance revisions as outlined. As a first step in the process, staff has identified issues for discussion with the Cable Companies. They are listed below for the Committee' s review and information. 1. Definitions - review for conformity with CCPA language and clarify as needed. 2. Franchise Renewals - revise for conformity with the COPA. Revise fee schedule. 3 . Transfers of Franchise - review the need for more specific language on franchise transfers. 4. Term of Franchise - establish appropriate terms of the franchise. 5. Construction and technical standards - ensure the standards conform to Federal requirements and FCC standards (also, determine if additional provisions are needed) . 6. Consumer protection standards - review standards that govern quality of customer service, such as, requests for service, repairs, interruptions, outages, telephone response time, billing, advertising, other telephone issues and complaint procedures. . 7. Insurance requirements - review for conformity with current County standards. 8. Subscriber rates - establish procedures to review and approve rates if the County is authorized to do so. Community Access review community access provisions, including the number and use of channels, interconnection of cable systems, cable company responsibility towards community access, County responsibilities, and emergency override provisions for disasters. 10. Other public, educational, governmental channel issues - review the need for rules for commercial channel use and ensure conformity with the COPA. 11. General types of programming - determine the need to establish general types of programming offered by the cable companies (CCPR option) . 12 . Privacy protections - ensure conformity with CCPA. 13 . Equal opportunity employment - review current provisions with County standards. This list of issues covers the basis concerns of staff. There may be additional issues brought up by the cable companies or in future discussions. Additionally the Board may identify additional issues for consideration. SH:eh iocomm
