June 23 , 1986 Cp^ SUBJECT; Formation of a Human Relations Commission SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: 1 . Refer the proposed budget for the Human Relations Commission to the Board' s Finance Committee for consideration as a part of the 1986-87 County Budget process. 2. Authorize the Executive Director, Private Industry Council, to circulate the draft ordinance prepared by the Design Committee for the Human Relations Commission to all individuals and organizations who had expressed an interest in the formation of the Human Relations Commission, as well as all school districts and cities. Any comments on the draft ordinance should be returned to the Private Industry Council for review with the Design Committee, following which a final proposed ordinance should be forwarded to the Internal Operations Committee by the Design Committee on July 28, 1986. Our Committee will then prepare a report to the Board outlining the policy issues which must be approved by the Board, following which the Board should request County Counsel to prepare an ordinance for consideration by the Board. BACKGROUND: On May 13 , 1986, the Board agreed in principle to reestablish a countywide Human Relations Commission. The Board appointed a group of three County staff and five community representatives as a Design Committee to prepare a proposed ordinance. The Design Committee was asked to report back to the Internal Operations Committee on June 23, 1986 . The Design Committee reported to our Committee on June 23 , as they had been requested to do. The Rev. Eugene Farlough, as Chair of the .Design Committee, presented our Committee with a report and a proposed ordinance. The committee recommended that the draft ordinance be circulated to interested parties for review and comment before our Committee and the Board make final decisions on the policy issues involved in forming such a Commission. We are, therefore, recommending that the draft ordinance be circulated, as noted above. At our meeting on July 28, we will consider comments made by various organizations and individuals and will also consider the other recommendations made by the Design Committee, following which we will make a final report to the Board on this subject. DATE: June 23, 1986 TO: Contra !�a Internal Operations Committee FROM: Rev ugeFarlough, Chair Human Relations Commission - Design Committee SUBJECT: PROPOSED CONTRA COSTA HUMAN RELATIONS COMMISSION Attached is a proposed ordinance to establish a Contra Costa County Human Relations Commission, and a proposed budget. The committee recommends the draft ordinance be circulated to interested parties for review and comment prior to your next meeting. The committee recommends the budget be referred to the Finance Committee for review during the July 21-24 budget hearings. The attached draft represents a consensus of opinion among the various viewpoints represented on the Design Committee. The Design Committee members are: Sandra Tomlin - Native American Heritage Preservation Project George S. Fujioka - Japanese American 'Citizens League Nina Aragon - Mt. Diablo Chapter - MAPA Rev. Eugene Farlough - Pastor, Sojourner Truth Presbyterian Church Bernie Bautista - Diablo Valley Filipino American League Arthur C. Miner - Contra Costa County Private Industry Council Perfecto Villarreal - Contra Costa County Housing Authority Warren Rupf - Contra Costa County Sheriff's Department The Design Committee also has the following recommendations: r It is important that the Commission be accessible to the County population, and ensure its meeting location and time do not preclude public access. The quality of Commission appointees will be key to the success of this program. It is essential that individuals who are selected to serve on the Commission are objective; have a background of integrity; are well respected in the community, and have a good record of community service. The Design Committee feels it is imperative that the Board ensure broad based Commission composition through an extensive recruitment process that results in only high quality appointments. Contra Costa Internal Operations Committee June 23, 1986 Page TWO If it is to be effective the Commission must have adequate resources. Therefore, the Commission must be adequately funded. Aware of the fiscal constraints the County currently faces, the Design Committee recommends a minimal budget that equates to less that 40 cents per County resident. The Design Committee recommends the County establish a goal of an annual budget of one dollar per resident and work toward achieving that goal as soon as possible. A majority of the Design Committee recommends that the Director of the Human Relations Commission have independent department head status and answerable to the Board of Supervisors and receive policy and program direction from the Human Relations Commission. It is also recommended that the Board undertake a strong affirmative action outreach effort for the recruitment of applicants to staff the Commission. The Design Committee acknowledges the staff support provided most ably by LeRoy Jackson and other members of the PIC staff. The members of the Design Committee recognized the importance of the project and appreciated the opportunity to work on the assignment. The Design Committee accepted the tight time lines due to the importance of the project and perceived them as an expression of confidence by the Board of Supervisors in the ability of the committee to draft, in a timely manner, a workable document. cc: Human Relations Commission - Design Committee Members r' } s ORDINANCE NO. An Ordinance establishing the Human Relations Commission The Board of Supervisros of Contra Costa County ordains as follows: Chapter Human Relations Commission. Section Declaration of Policy It is the public policy of the county that all persons residing or visiting in the county, irrespective of their age, race, religion, color, sex, ancestry, national origin, handicap, or sexual orientation, may enjoy an equal opportunity to live, grow, learn, work, play, worship and exercise the responsibilities of citizenship, unhampered by invidious discrimination. The county will act to insure and effectuate the constitutional and moral rights of each individual in the county to equal economic, political and educational opportunity; to equal accommodations and service in all business establishments in the county; and to equal service and protection by all . public agencies in the county. An instrumentality hereby identified as the Contra Costa County Human Relations Commission is established for the betterment of Human Relationships: to eliminate prejudice and discrimination because of age, race, religion, color, sex, ancestry, national origin, handicap or sexual orientation; to inform the ainhabitants of the county of developments in human relations; to provide expert advice and assistance to the officers, agencies, boards, departments and employees of the county and other public and private organizations in undertaking ameliorative practices to keep peace and good order; and to officially encourage private persons and groups to promote and provide equal opportunity for and good will toward all people. . Section Powers and Duties The Powers and Duties of the Contra Costa County Human Relations Commission shall be as follows: a. To consult and cooperate with the Board of Supervisors and federal, state, city and other local public agencies in developing programs and techniques for achieving harmonious intergroup relations within the County of Contra Costa. b. To study, investigate, mediate and hold public hearings on community-wide problems arising in this County which may result in intergroup tensions or discrimination because of age, race, religion, color, sex, ancestry, national origin, handicap or sexual orientation. i c. To solicit the cooperation of various racial, religious, educational and ethnic groups, fraternal and police associations, labor & business organizations and other groups in fostering mutual understanding, respect and goodwill among all persons in the county. d. To prepare and disseminate information, and to offer guidance, technical assistance and/or recommendations to public agencies and private persons, organizations and institutions toward the engagement of activities and programs intended to eliminate prejudice and discrimination. e. To receive and/or refer to appropriate agencies complaints of Y, discrimination and instances of prejudice against any persons or groups, with special attention but not limited to, the categories of employment, education, housing, public accommodations, and police/community relations; and to seek resolution of su=h matters through consultation, conciliation and advice. f. To initiate, develop, plan and/or administer educational/social programs to improve the quality of intergroup relations and to study patterns of discriminatory behavior and practices. To recommend legislative and/or policy changes toward bettering human relations. g. To conduct public hearings within the scope and function of the commission at which testimony may be taken under oath. In the case of ' the refusal of any person to attend or testify as requested, the commission may, upon the affirmative vote of 10 or more members, proceed to petition for a court order pursuant to section 1991 of the California Code of Civil Procedure. At any hearing, before the commission, a witness shall have the right to be advised by Counsel present at the hearing. h. To act as conciliator and mediator upon request of any party to a dispute or controversy within the scope of purposes and functions of the commission. i. To refer problems or disputes that are properly and exclusively within the scope of duties of other public agencies to such agencies. J. To render to the Board of Supervisors, at least once each calendar year, a report or reports of its activities. f Section Commission Membership, Composition, and Appointment a. The commission shall consist of fifteen (15) members. b. The membership shall be broadly representative of the general public including, but not limited to members of business, labor, religious groups, education, criminal justice, community organizations and characteristic of the County's diverse population with respect to sex, sexual orientation, ethnicity, disability, economic disadvantage or age. C. Commission members shall be appointed by the Board of Supervisors as a whole from among individuals formally applying for or nominated for membership, subject to the condition that all members of the commission must be county residents and at least one commission member must reside in each supervisorial district. There will be public notice of vacancy prior to appointment. r Section Terms a. The Commissioners, upon appointment, shall serve a term of three (3) years and until their successors are duly appointed; but the first Commissioners shall classify themselves by lot so that five members serve for three (3) years, five serve for two (2) years and five serve for one (1). Any vacancy shall be filled for the unexpired term in the same manner and consistent with Section b. and c. b. Commissioners may not be appointed to more than two (2) full three e year terms. This does not include initial appointments by lot or unexpired terms of less than three (3) years. a C. A vacancy shall exist and shall be reported to the Board of Supervisors whenever a commissioner has three (3) consecutive absences from regular meetings of the commission. Section Organization and Meetings a. The Contra Costa County Human Relations Commission shall meet at least once a month. The commission shall select its chair, and shall adopt, by a majority vote, such rules as it shall deem expedient for the conduct of its business. P"" b. The commission may establish standing or ad hoc committees at its discretion, and define their area of operation and concern. Ad Hoc committees may be composed of persons not holding membership on the commission except that the chair of each such committee shall be a commission member. C. All meetings of the commission shall be public except as provided in Government Code Section 54957. t Section Compensation Commission members shall receive a stipend for attendance at any Human Relations Commission or standing committee meeting in the amount of fifty dollars ($50.00) per meeting but not to exceed four (4) meetings per month. Section Staff a. The commission shall be staffed with a Human Relations Director and additional appropriate staff. The Human Relations Director position shall be exempt and appointed by the Board of Supervisors. x 6 b.
