June 18, 1986 COO^ SUBJECT: Legislation: Assembly Bill 1801 (Robinson) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position of support for AB 1801 by Assemblyman Robinson. BACKGROUND: Under current law, the California Supreme Court has determined that airport noise is a continuing nuisance. As a result, property owners affected by the airport noise can sue the airport an unlimited number of times. This results in the potential for never-ending lawsuits and substantial legal costs. Assemblyman Robinson has introduced AB 1801 in an effort to overturn the Supreme Court decision. This bill declares that airport noise is a permanent nuisance rather than a continuing nuisance. This would limit lawsuits to a single suit over the existing level of noise and would prohibit further lawsuits unless it can be shown that there has been a substantial increase in noise, or other adverse environmental effects, caused by the operation of an airport. The Airport Manager strongly recommends that the Board support AB 1801 and this office concurs in this recommendation. CONTINUED ON ATTACHMENT: YES SIGNATURE: I AiCIiiU.
