SUBJECT: Legislation: Senate Bill 1734 (Morgan)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) a BACKGROUND AND JUSTIFICATION
RECOMMENDATION-
Adopt a position of support for. SB 1734 by Senator Morgan.
BACKGROUND:
Under existing law (Water Code Sections 13751 and 13752) , anyone
who digs a water well, abandons or destroys a water well, or
deepens any such well, is required to file a report with the
State Department of Water Resources within 30 days after the work
has been completed. The report must include at least the
following information:
( a) description of the well site sufficiently
exact to permit location and identification
of the well;
(b) detailed log of the well;
(c) description of type of construction;
(d) details of perforation; and
(e) methods used for sealing off surface or
contaminated waters.
This report is not public, but may be made available to
governmental agencies for use in making studies.
Senator Morgan has introduced SB 1734. This bill would add to
the report requirements the requirement that the signature of the
well owner, or authorized representative, and the well driller be
included. In addition, SB 1734 makes the reports public
information and specifies that they shall be made available for
inspection by the public.
The Health Services Department has found a number of instances
where the release of these reports to hydrogeologists or
consulting engineers would have provided/ valuable data in
