HomeMy WebLinkAboutMINUTES - 06101986 - X.15 TO: BOARD OF SUPERVISORS FROM: Tom Powers , First District Supervisor Contra Costa DATE: June 10 , 1986 County SUBJECT: Support for a Federal Consistency Determination SPECIFIC REQUEST(S) OR RECOMMENDATION(S) a: BACKGROUND AND JUSTIFICATION Recommendation: Request the County Counsel, Community Development Department and our representatives on BCDC, Nancy Fanden and Harvey Bragdon, suggest that the Bay Conservation and Development Commission determine whether a Federal Consistency Determination under the Coastal Conservancy Act is required because of the Southern Pacific/ATSF Railroad merged operations in Contra Costa County. Also, urge that such a Consistency Determination be made by the Commission and prepare an appropriate letter of request for such action. Background: The SP/ATSF merged operations in Contra Costa County are bound to cause significant impacts on the environment. Access to shoreline, sound, increased rail traffic effects and other impacts on the communities will occur. It is apparent that the Interstate Commerce Commission is not paying close attention to these concerns and therefore we need to make as many efforts as possible to insure the ICC ! addresses these concerns. At a meeting on June 5, 1986 with concerned cities in Contra Costa County, the East Bay Regional Park District, representatives from the State Legislature and the county, various assignments were given to address these mitigation measures. It was my task, as a representative from the county, to seek the Board' s support to ask BCDC to insure that the ICC carries through with its part in insuring the Coastal Conservancy Act is observed. This act impacts the shoreline area and addresses the environmental effects of activities to the shoreline surrounding the Bay. If there are environmental effects, then the Bay Conservation and ! Development Commission can request that a Federal Consistency Determination activity take place and that the effected Federal agency go through a process to insure that they are being consistent in their activities with the Coastal Conservancy Act. It is this activity for which I seek the Board' s support.
