Adopted this Order on June 10 , 1986 , by the following vote:

SUBJECT: Hearing on Rezoning Application 2664-RZ and Development
Plan No. 3017-86 Filed by Barry E. Whittaker (applicant)
and Frank Molta (owner) in the Martinez area.
This being the time for hearing on the recommendation of
the Contra Costa County Planning Commission with respect to the
application filed by Barry E. Whittaker and Frank Molta (2664-RZ) to
rezone land in the Martinez area from Single Family Residential
District (R-10) to Planned Unit Development (P-1 ) together with
Development Plan No. 3017-86 for three single family detached
houses.
Harvey Bragdon, Acting Director of Community Development,
described the property site and advised that a Negative Declaration
of Environmental Significance was posted for this project.
The Chairman opened the public hearing. No one appeared
in opposition to the project. The Chairman closed the public
hearing.
The Board considered the matter and IT IS BY THE BOARD
ORDERED that rezoning application 2664-RZ is APPROVED as recommended
by the County Planning Commission and Development Plan No. 3017-86
is also APPROVED subject to conditions imposed by the Planning
Commission and the Board of Supervisors as set forth in Exhibit A
attached hereto and by reference incorporated herein, and the Board
hereby adopts the Planning Commission's reasons, set forth in its
Resolution Number 23-1986 as its determinations for this decision.
IT IS FURTHER ORDERED that Ordinance Number 86-46 giving
effect to the aforesaid rezoning is INTRODUCED, reading waived and
June 24 , 1986 is set for adoption of same.

CONDITIONS OF APPROVAL FOR DEVELOPMENT PLAN 3017-86
1. Development shall be generally as shown on the plan submitted with the ap-
plication dated received on February 24, 1986, by the Community Development
Department and these conditions of approval . Development shall be subject
to final review and approval by the County Zoning Administrator prior to
the issuance of .a building permit.
2. Comply with the landscape and irrigation requirements as follows:
A. Landscaping shall be generally as shown in the preliminary planting
plan submitted on February 24, 1986. A final detailed landscape plan
shall be submitted for Zoning Administrator review and approval before
issuance of building permits.
B. All trees shall be 15 gallon size, all shrubs 5 gallon size.
C. All, cut and fill bank areas shall be hydroseeded with a mixture of
wild grass and California wild flower seeds.
D. Plantings on bank areas shall not only include the proposed trees and
wild flowers - grass seed hydro mulch, but scattered drought tolerant
bushes.
E. Landscaping shall be installed prior to occupancy of any house.
F. Front yard lawn areas of each residence shall be equipped with a
sprinkler system. ,
G. An acceptable means for the replacement of dead or dying plants in the
scenic reserve shall be developed. The means shall last for 3 years
after the initial planting of trees and bushes.
H. An agreement for the maintenance of landscaping within the right of
way of Wildflower Way and Broadway shall be developed, subject to Zon-
ing Administrator review and approval .
3. Exterior lights shall be deflected so that lights shine onto applicant's
property and not toward adjacent properties. A detail of proposed outside
lighting fixtures shall be submitted for the Zoning Administrator's review
and approval.
4. Comply with the requirements of the Contra Costa County Consolidated Fire
District.
5. The Zoning Administrator shall review and. approve fence details of this
project. Where necessary, perimeter fences shall be repaired or replaced.
6. Parking and driveway areas shall be paved as to .prevent ponding of water or
the creation of dust.
7. If archaeologic materials are uncovered during 'grading, trenching or other
on-site excavation, earthwork within 30 meters of these materials shall be
stopped until a professional archaeologist who is certified by the Society
of California Archaeology (SCA) and/or the Society of Professional Archae-
ology (SOPA). has had an opportunity to evaluate the significance of the
find and suggest appropriate mitigation measures, if they are deemed neces-
sary.
8. Comply with the Park Dedication Fee requirements of the County Ordinance.
9. Sewage disposal serving the properties concerned in this application shall
be provided by the Mt. View Sanitary District. :Each lot shall be served by
a separate sewer connection. The sewers located within the boundaries of
the properties concerned should become an integral part of the Central
Contra Costa Sanitary District's sewerage collection system.
10. Water supply serving the properties concerned shall be by the Contra Costa
County Water District. Such water distribution system, located within t he
boundaries of the property concerned in this application, shall become an
integral part of the Contra Costa County Water District's overall water
distribution system. Each individual lot will be served by a separate wa-
ter connection.
11. Covenants, Conditions & Restrictions shall be submitted for review with the
Subdivision Map, subject to review by the Community Development Department.
This document shall' provide for establishment, ownership and maintenance of
the scenic reserve parking, fire protection,, fencing, 1'andscaping in public
street right of way and drainage maintenance, keeping of pets and estab-
lishment of signs. The Covenants, Conditions and Restrictions for the
three lots in this application shall be the same as that for Development
Plan 3053-85 and Subdivision 6695.
12. Submit final grading plan for review and approval for the Zoning Adminis-
trator.
13. Each house shall have address numbers that are clearly visible to the ac-
cess road day and night. Each house shall be equippedwith automatic ga-
rage door openers.
14. Comply with the drainage, road improvement, traffic and utility require-
ments as follows:
A. In accordance with Section 92-2.006 of the County Ordinance Code, this
subdivision shall conform to the provisions of the County Subdivision
Ordinance (Title 9). Any exceptions therefrom must be specifically
listed in this conditional approval statement.
B. Prior. to issuance of building permits, file the Parcel Map for Minor
Subdivision 13-86.
C. Relinquish abutter's rights of access al.ong all curb returns within
the subdivision.
D. Prevent storm drainage, originating on the property and conveyed in a
concentrated manner, from draining across the sidewalk and driveways.
E. Furnish proof to the Public Works Department, Engineering Services
Division, of the acquisition of all necessary rights of entry, permits
and/or easements for the construction of off-site, temporary or perma-
nent, road and drainage improvements.
F. Establish covenants, conditions and restrictions for the development
that clarifies that all storm drain facilities within the development
will be maintained by the homeowners of Minor Subdivision 13-86 and
Subdivision 6695.
