SUBJECT: Determination of Property Tax ) Transfer for the Ellinwood II No. 57) Boundary Reorganization ) RESOLUTION NO. 86/ 334 (LAFC 85-34) ) WHEREAS, the City of Pleasant Hill has initiated proceedings for the subject reorganization consisting of detachment of territory from the City of Concord and concurrent annexation of the territory to the City of Pleasant Hill and the Pleasant Hill. Recreation and Park District; and WHEREAS, Section 99 of the Revenue and Taxation Code provides that the Cities of Concord and Pleasant Hill shall negotiate a property tax exchange agreement among themselves and that the Board of Supervisors shall adopt a property tax exchange resolution on behalf of the district involved in the jurisdictional change; and WHEREAS, the City of Concord has adopted a resolution agreeing to transfer to the City of Pleasant Hill' all of its property tax revenues (base tax and annual tax increment) from the affected territory of the reorganization; and WHEREAS, the City of Pleasant Hill and the Pleasant Hill Recreation and Park District have adopted resolutions agreeing to share the property tax revenues (base tax and annual tax increment) to be transferred from the City of Concord on the basis of the following percentages: City of Pleasant Hill 37 . 410; Pleasant Hill Recreation and Park District 62. 590. NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY DOES HEREBY DETERMINE THAT 100% of the property tax (base tax and annual tax increment) accruing to the City of Concord from the affected territory of the proposed reorganization shall be transferred to the City of Pleasant Hill and that the City of Pleasant Hill shall transfer 62. 59% of said tax revenue to the Pleasant Hill Recreation and Park District for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change. The terms of the property tax transfer shall apply in subsequent years unless changed by the mutual agreement of the affected agencies or subsequent jurisdictional changes. This resolution does not change the property tax revenues accruing to other agencies servicing the subject territory or the affected agencies' right to collect taxes for existing bonded indebtedness. The property tax exchange agreement discussed above shall apply to all affected territories as submitted or revised by the Local Agency Formation Commission. 1 he certify that this is a true and correct copy of OricY.
